URGENT: Just got screwed on a car

just got a '94 civic with 113k miles. In pretty good shape but a bit beat up on one side. I got it for $1900. Gave him 400 cash and a check for 1500.
I just checked the carfax and it said it was salvaged in '01 and had over 150K miles in feb of '02.
I thought to check the carfax after I was about to transfer the title where it read N/R for mileage.
This guy sells cars for his business as well as has some other business. Saw the ad in the star trib and he lives like 2 blocks from me. Her told me it was a clean title and that it had 113k miles.

Any input would be great. I stopped payment on the check tonite as it wasn't seen in my acct yet and will call him tomorrow.

If the bill of sale for the car says "As-Is" anywhere, you're SOL. In fact, you're likely SOL anyway. Why the hell didn't you do a CarFax BEFORE handing over $1900?

I feel sorry for you. I hope it works out but... get the JY out b/c you may get screwed more if he sues you over the check stoppage.

But if he entered the contract based on a lie, then he is not subject to the terms of the contract. The owner should know the status of a title, after all it is quite hard to hide a salvage title.

He may have to go to court if the guy doesn't give him his money back and I think he'd win.

[edit] erm...wouldn't the title state salvage on it if it was a salvaged title?? Maybe Carfax is wrong. You might have to do some investigating to get to the bottom of this.

Exactly, it is his fault that he lied to you, but I think buyer has the sole responsibility to make sure they check what they can with the car. So, after agreement of the transaction, you should not stopped the check just because you didn't do your work beforehand.
 
Same thing what my friend did.

Purchased a car without running a carfax OR even test driving it.

Man, you don't deserve to own a car or my friend.

I'd advise you go ahead and let that check go thru... I spent a night in jail and $2000 in lawyer fees for doing the exact same thing. It is a felony!

No hes not screwed. We learned about this in business law. The dealer created a warranty when he said that the car had a clean title and only 113k miles. You cant make claims to a warranty and then disclaim them later. You have a case and you should be able to get all your money back.
 
What do you have in writing? That's the key, if he *told* you the clean title or the mileage you're out of luck. If he advertised it that way or wrote the mileage or title status down and it's false then you can get out of it.

You should have to pay him the $1900 as a penalty for you being stupid. Exactly how far up your a** was your head when you signed over $2000 to a used car dealer without checking out the car FIRST?????

He's gotta pay the guy before he can take him to court though... like I said I found all this out the REAL HARD way... Let that check clear or you are screwed.

Exactly the way I feel, He verbally said it was clean title twice and said and I have it on his paper that it had 113k miles. I think he will go straight on the deal, I just don't know how straight he will go. I will let y'all know tomorrow nite what happens.

The JY? hahahahahahaha! I got screwed on a car before that was $1250 but had a clean Carfax report and everything. Thing is there were major oil leaks and have recently had the tranny rebuilt and am now getting a rebuilt engine in there.

people really need to take cars to a mechanic before buying them...
