Well, OK, I had an iMac sent to me via UPS. So this email string starts off as me complaining about the long, unexpected, unneeded wait for my package due to a "major weather condition". (delayed 3 days of 3 business day shipping...it was only bad weather for one day...) I guess they don't give you a refund on shipping. Well I received my package, YAY !!!!! Open the box to find out the bezel on it is cracked, BAD, like it was housed in the World Trade Center on Sep. 11 :p.
Ok so here is the emails (forgive me for spacing and what not)

My package has been delayed WAY too long.
The first day it was delayed (Tuesday it was pretty dangerous), but NOW it is just getting ridiculous adverse weather MY ASS. Streets have been fine for 2 days (since Wednesday morning). These excuses are just RIDICULOUS.

I'm not too worried about the delays NOW. I am still pursuing the damage
claim.

I REALLY would like to know the status of my claim. You guys dropped MY PACKAGE, I want to know about MY PACKAGE. The seller has not responded to my emails/private messages. Can you PLEASE just give me my claim and be done with this? I have been waiting almost 3 WEEKS for a replacement of my product. I don't care about the seller, I can SEND pictures of the DAMAGE, I will do ANYTHING required for me to "SPEED" this claim up. Has the seller even responded to you?

Can I please talk to your supervisor about this claim? I am getting very
frustrated with this company (UPS). I have tried to contact the seller like
you advise. They have said nothing to me as of yet. I am desperately trying
to get this solved as I cannot use the product I had sent to me. I would
very much like for you to transfer me to someone who can solve this (unlike
you have tried to do).

Wow, I am really surprised you guys can copy and paste and expect to satisfy customers. Well I am not satisfied with your company and their handling of claims. I would like to be redirected to someone that does not copy and paste a resolution to a problem. If needed I can share this information regarding your "resolution" of my claim with hundreds of my peers. I just hate when people PAY YOU to ship something and you break it and take no fault in your mishandling.


Has anyone had this kind of trouble? This is just ridiculous, I have been arguing with a robot for 2 months!

You are not their customer (the shipper is), and therefore they have no obligation to submit to your demands.

AFAIK UPS sends out the checks. They give you so and so amount of insurance on your package included in price. So... wouldn't they just give the money to the customer/receiver?

Because their customer is not you, it's the person that paid them to send the package.

UPS can't do anything with you. You didn't pay them, so the claim (if any) has to go to the shipper (ie, the seller). They can't directly pay you a damage claim, or even a shipping refund for not delivering the package in time.

Talk to the seller. If the seller won't talk to you, you need to document everything, and then you need something like small claims court.

Also, the receiver should receive the compensation correct? Is it possible the seller took the money and ran?

You should be mad at the seller, not UPS. The seller is the UPS customer and the only one that can file the claim. You can whine to UPS all you want, it's not going to help.

The insurance I believe is 300$ per box (by default). No, this was on a Mac forum. He has posted there a few times since my PMs but haven't answered them....

No. They can only refund/compensate the person who paid for the shipping.

Yes. But you need to make some reasonable efforts to contact the seller before you can pursue anything else.

In theory you should ship the damaged item back, and then the seller can inspect it and file a claim with UPS. They're certainly not going to refund you without getting the item back.
