Update on Child Custody

Went to the attorney today and she seemed to think we had enough to file a motion. We have to ask for a parental evaluation too. She wants us to go back to her office within a few weeks (when she completes the motion) for us to look over everything. I have to prepare exhibits that support our case. Then we should know how strong our case is. If the parental evaluation comes back in our favor then we can almost certainly win in court. If not, the least we can do is go to mediation and develop a new consent order which shows the new days we agreed to a few months ago.

What a nightmare this must be. I feel badly for you...I can understand what you're going thru.

More evidence to support the idea that you should be ABSOLUTELY sure that you can live with someone for at least 18 years if you're going to have a kid with them.

Michael, you are absolutely right. The pregnancy wasn't planned. So for those of you who frequently sleep with women you aren't married to! BEWARE! Condoms don't always work....and Babies Happen! Don't think it won't happen to you. Don't believe a woman when she tells you she can't have babies. Until you see a written confirmation from a doctor you better keep the slinky in your pants ;)

The attorney said the good thing is we basically already have the counselor on our side. Now all we have to do is get one more professional on our side. The person that does the parental evaluation will also talk to the counselor.

I don't believe that postition is truly tenable. There are any number of possible circumstances which would make divorce or seperation the best option. What's truly unfortunate is that a child is being held hostage by the resentments of adults.

Having the counselor in the bag is about 60% of the battle, IMO. :) Best of luck to you.

AMEN!!! I have a wonderful 10 yo son because of that, and love him more than anything, but it has been a LONG road, I have primary customdy, and she is supposed to pay me child support, and doesn't (A whole other story).. It's literally a Jerr SPringer episode, and I wouldn't wish it on ANYONE.

Remember kids, there's no such thing as free sex.

I'm a paralegal. I can do it for free or pay the attorney. It reduces our fees by allowing her to work on the "grit" of the case while I put together the supporting evidence. Remember, you only pay the attorney for the time they work on the case. The more I do the less we have to pay :)

It won't take years. It should be over in July. We will file the motion, parental evaluation, go to mediation, go to court if mediation fails.
