Long story short my 18 year old brother had people over drinking last night because our parents were gone. A 15 year old came over, already drunk, supposedly drank more over here. I pull into my driveway to see 3 cop cars there and cops looking through my windows. They say the 15 year old got alcohol poisoning and got sick. They ask to search the house and I refuse because they dont have a warrant. I go through the house to look for my brother and he is not there, nobody is home. The cops say they will be back tomorrow for my brother. My question is how much trouble my brother is in, what would any of you suggest that he does when he talks the the cops. I told him if they start asking alot of hard questions, stop answering and ask for a lawyer.

Please Help.

Update 2:

So it turns out some other girl that neither of us know had a party on the same night. Some 15 year old got drunk and sick at her house. She somehow knew my brother was having a party and told the kid who got sick to say he was over our house drinking. My brother has had several of his friends call the police and tell them this so we are in the clear.

I cant even explain how pissed off I am at this girl though. I really want to find out who she is, go over her house and just bitch her out until she cries.

Well, I'm assuming there's a fair amount of trouble here. Was definately a "you have chosen.... poorly" incident. From the sounds of it, a lawyer wouldn't be a terrible idea, but I dunno. Suppose it depends a bit on what the cops are wanting to do.

You give or supply a setting for alcohol to come into the hands of someone under 21 you are in serious trouble. It only takes one person to save their own azz and say ?They gave it to me? and he is in MAJOR trouble.

Your brother is not very smart is he.

Play dumb and get a lawyer. Tell him to answer I don't remember or don't know. Don't let him answer any questions that could come back and bite him.

 
Just make sure you clean your house out of any alcohol now! Or he can say he didn't supply anyone with alcohol and that they must have consumed it with their own stuff when he wasn't looking.

Can't your bro say that he was already drunk when he came over? It would be his word against the 15 year olds. It would be kinda hard to prove that the kid actually was drinking at your house wouldn't it?

Does not matter, he is under 21 and there was drinking going on there. Who do you think a judge is going to believe?? And all they do is get one person again to save their own azz and point the finger, and his Bro is in REAL hot water. Thats why he needs to play dumb and see if it will blow over. If not then get a lawyer.

This is why a lot of college parties are BYOB, you serve no alc, you got little to no problem( for the most part that is).

Most colleges parties are BYOB because you cant buy a keg and expect people to pitch in on paying for it. 2nd if you provide a place for minors to consume alcohol that as good a buying it for them.

Yup. But I also think that the parents (who I assume own the house and failed to supervise minors in their household properly) would need a lawyer a lot more than the brother.
 
Update:

My brother talked to everyone that came over. Nobody was 15 and nobody got sick. Which means that the police probably saw all the cars in the driveway earlier in the night and the night before. They were just looking for an excuse to get in and make arrests.

The police in my town have lost ALL of my respect.
 
How do you know they lied? Maybe someone called in a report about your party. A neighbor perhaps? Or the parent of a 15 year-old who got sick from alcohol?

Where the hell are your parents? I'd tell them and then wait for cops to press charges if they even can. Police have/will lie to get you to admit to doing wrong, i'm not saying they are in the right, but FFS dont put yourself in a position that you can get in trouble like that. It's like speeding and then wondering why you got pulled over.....
Thats why growing up in my town we always had the parties on the beach.....

I highly doubt anybody called in the the police. We get along very well with out neighbors. One of my neighbors even had a huge party 3 weeks ago, music was playing wel passed 4 am and I could hear it even though my windows were closed. Nobody over my house was outside and there was no loud music playing. Nobody parked in the neighbors yard or even on the street.

My guess on what happened is, I had people over Friday night , cops drove by, saw lots of cars in the driveway but couldn't do anything since everybody was inside. Cops drove by Saturday night, saw lots of cars and probably saw some younger (16-18) kids walking in the house and made up some BS story to try to bust us. Since the cops never came back on Sunday I'm assuming they let it go.
