Uninsured motorist coverage is to cover bodily injury resulting from an accident that is the fault of an uninsured driver.

FYI.

This varies from state to state. In the OP's state, they are not required to carry UM at all. Learn something every day.

Insurance covers the driver, not the car. You need to go after the woman driving, not the car owner.

i hear u on that. she was going back 20 mph and i was just accelerating from my stop position since i stopped at my stop sign. Now if she freaking stopped like 10 feet from the intersection, then yes it was my fault.

If you don't have insurance you should not be allowed to drive period.

In VA the the State makes you pay a $500 "uninsured motorist fee" if you don't have insurance and you want a license. This fee does not provide any coverage at all(it's just a money making scam) They should just flat out refuse the license to protect the public good.

Oh, now the uninsured scum bag is going to drive without a license now? 6 months mandatory in the stockade, no questions asked. Driving is a privilege not a right. If you can't abide by the rules you'll suffer greatly.

FTW:
VA also has required minimums when it comes to insurance, which makes no sence to me because they allow people to drive without insurance and said people in no why, shape, or form have personal financial responsible to cover themself for the required minimums

Your rates are based on your primary vehicle as that's the vehicle you're going to (or atleast should be) driving a majority of the time. I'm not retarded/lying to you/making this up. Speak with your insurance agent.

The funny thing is, she wants to settle it w/o the cops and insurance company and asked if I was willig to pay for the damages?! I'm like no way so I called the cops. Turns out it wasnt her car (it was a friends) and the car had its insurance cancelled. So, now I sit and wait to here what will happen now.

She said I ran through the stop sign but the cop even acknowledge that the damage to my car looked like she was at fault since she hit the side of my bumper (in front of the tire) while the front of her car had slight damages to it. Good thing is I have uninsured motorist coverage. I need a new car so hopefully I can get a check and go buy a new car anyways. The transmission and oil are leaking way before this accident! :(

I have State Farm, I wonder if they cut you a check or do they pay the body shop personally after the estimates are in?

DO NOT MAKE ANY DEALS W/HER!!!!!!! too many things can go wrong and u get screwed!

she's the driver. if she had insurance (auto or homeowner's) her policy will pay.

if not, the let YOUR insurance company deal w/it.

your insurance company either gives u a check, or u goto one of their approved shops to get car fixed.

either way State Farm will go after the other party for repayment.

What if the damage is worth more than the car. Last time I checked i think my car is worth no more than $2000.

Then you'll get a check for the value of the car.

Make sure you go fight for the blue book value. Do not accept the Nada value which is less.

lilicam... if the car isn't worth fixing, then State Farm will total it and cut you a check. If it is worth fixing, they'll pay the shop directly and/or cut you a check at their discretion.

From the sounds of it...SF will probably total the car.

Not if he doesn't have collision coverage on his vehicle. If he only has liability, and no UMPD, he is screwed.

Looking at my policy it states "500 Deductible Collision" so I'm hoping that's a good thing! We have 3 cars so I cant remember which car doesnt have the collision. I also have Uninsured and Underinsured Motorist Bodily Claim, but I understand that won't matter in this case.

so sstate farm will give u price of car minus $500. then go after the woman. if they collect, then they'll give you the $500 since it wasnt your fault. (deductible only app;lies if it was your fauylt)

Comprehensive Coverage: $500 deductible
Collision Coverage: $500 deductible
Uninsured Motorist Coverage: Deduct $20,000 damage out of the person's backside

I pay my outrageous insurance prices, so should they.

Lesson: ALWAYS call the cops if you see any damage.

Interesting that UM isn't required in his state.
Required or not, its still a good idea.
UM coverage is contractual--your actual policy will define what is covered.
