Underaged drinking....

Ok say your 17 years old, you've had your license for a while and you go to a party with your friends. Your friends drink and you don't, being the friend that you are, you drive them home. Now there isn't and alcohol in the car and you drive you friends home, your driving home and a cop pulls you over. Now being drunk and underage I'm sure your going to get in trouble, but the question is now, does the DRIVER who is sober get in trouble? And also, what if one of your drunk friends brings a beer in the car and is drinking it while you get pulled over, does the driver get in trouble?

edit: he'll probably let you go as long as you didn't have a drop, but you really shouldn't be at 21+ parties unless you are well...21. however, if your friends are over 21, and you are just a sober cab, that is a different story.

I had to drive my drunk mother-in-law home a couple of times (she was my girlfriends mom at that time), and I was under 21.
 
Oh and the "friends" are also underage (bad), this is just hypothetical. I'm assuming they'd be arrested but I'm not sure if the driver would be. I think it would be pretty messed up if they arrested the driver because you know the whole don't drink and drive thing, like get a ride home etc..
 
Depends on the cop. He can get you for underage just for being there. I've been at parties that the cops showed up where most people where underage, but they let everyone go.

Depends. But don't have ANY open drinks in the car. I am sure the cop will see you are sober and being a good friend by taking them home so they don't hurt themselves or anyone else.
 
there is no law about being drunk underage. The law is about drinking. Once its been consumed youa re breaking no laws so long as you are in the privacy of a home or car etc.

This happened years ago to me and my friends...cop just made us pour out the 20 or so beers we had left from the party and sent us on our way.
 
If you live where that one guy who got pulled over going 10mph does, the cops will probably cut an arm off, beat one of your friends to death with it and stuff a potato in your exhaust pipe.

If you have sane, respectable fuzz in your area, you won't get in trouble.
 
i got pulled over when i was 18 or so. it was my friend and i and 2 chix0rz in the back. each of us was on our first beer.

the cop made us dump our current beers but he didn't look in the trunk where there were 20 more coldies. what a n00b. eheh

but yes, we were charged with "liquor out of residence" or something. can't remember the exact wording.

if it turned out to be a big deal...get a lawyer.....hopefully he will pull the old...he was doin a good deed by driving everybody home and didnt notice that one of them had the open container.

judge might let u go..... would also help if one of the others that would be in trouble anyway own up to it and say he snuck it in when u werent lookin

Cop did yell at the drunk friend who tried to drink some of the 3rd one before he poured it out.

There is a Consumption of Alcohol underage law in a town about 20 miles south of me.

My question always was, when I was under 16 and I drove me and my brother home from the races after he was drinking and I had my permit and not my license.

Of course I'd ask the cop if he'd rather have me driving illegally or my brother intoxicated, but the situation never arose.
 
As long as your not intoxicated and there are no open containers in the car, I'd think the cop would thank you because you are stopping your friends from driving while under the influence

Laws vary WILDLY between different states and different municipalities. Do not take this comment at face value without checking out the laws that cover your city and state.
 
it happened to me and the answer would be no.

my friend was sober and he took care of me. five people were in his car when he was pulled over. cops had a talk with them and gave them options. we chose to go home instead.

i think that cop was that stupid. he gave us choices: all of us would be in jail, cops would take care of that drunk guy (not me but my other friend) or let us go.
