Uncapping Cable Modems - Legal or not?

This past weekend I was over at a friends apartment. They had a friend they knew come down from Detroit to hang out. He uncapped their cable modem and majorly increased their upload and download speeds. We had 4 guys playing CS 1.4 and 1 guy downloading large files *cough*Jason X*cough* (which sucked majorly) and had 50 pings a peice and the one guy was getting 200+kb/s. Now I have the same cable provider and cable modem and am contemplating this. Questions that arise are : is it legal? could the cable provider find out? how much trouble could one get into?

At the very least it would violate your TOS, & they would probably nuke your account. Would you get into trouble beyond that?

The probability of them finding out is small, but there is always a chance they could. Not to mention you would go back to dial -up.

Probably the most they would do is shut down your connection.

I'm surprised that there are any services left that aren't capping it at the upstream.

Actualy, I believe most cable providers have checks to determine if someone is using an uncapped modem. I heard someone around here say (sorry, can't find the link) that an uncapped modem stands out like a sore thumb. Its definitly not legal (If the cable company wanted you to have uncapped access, they would not have had placed a cap on in the first place), and they definitly will find out about it eventualy.
 
thats a pretty old provider you have that still caps at the modem...u'll violate TOS like what the rest of the people say. if the modem is rented, you'll owe them a modem when they kill ur acct and so on so forth.
 
You could have 4 people playing CS and another person downloading at 200k fairly easily on a normal cable modem. AFAIK uncapping a cable modem is impossible. Most of the programs that say they will do it are fake. If in theory you were able to do it, it would not be illegal, but it would violate the TOS of your account and they would kick you off.

Cable uncapping was possible back when cable modems were brand new, but with the newer DOCSIS modems it's not possible. I would guess you guys were just on at a good time.
 
Well, it will violate your agreement with them and give them all the justification to shut down your account without notice. Is it worth it?

As for getting caught, it depends on your service provider. Some monitor their network closely, others do not. Again, is it worth it? If they are the only broadband provider in your area, you better think carefully before doing it.

I read something on it a bit ago actually, I think someone was tricking the model into using your pc as a tftp server, instead of the isp so it pulled the config files off you instead of them when the modem started up, so you could uncap it possibly. I'd also imagine though that one user pulling 1 meg/sec+ on a 128k would stick out pretty bad.

well this program makes it so that instead of the cable modem downloading a file from the isp (the file tells the modem how much it can upload/download) that it downloads a file from my computer that tells it how much to allow for upload/download

we also ran dslreports.com test and it said that it was way higher than a regular cable modem

AFAIK it is still possible on some circuit/modem combinations. Talk to FFMCobalt, he knows a lot more about cable than I do.

However...

If you can befriend a cable technician they can do it for you. My roommate had his line uncapped for quite some time before the whole @Home thing hit the fan. When he got re-provisioned he lost it.

T1 is only 1.5Mbps. Many cable connections are already faster then that.

I have done it before on my friends box, just to see if it actually worked. It does.
I wouldnt recommend doing this though, we put his back quickly after.

good luck dude... i know here it is capped back at their place... so even if i were to trick the cable modem at my house, doesnt mean i am tricking them back at headquarters

If I could uncap my cable modem, I would have done it by now. The only way to boost my painfully slow speeds (1000 down/128 up) is to break into the cable company's "account server" and update my account settings. And yes, 1000/128 is ridiculous because I had 3000+/1000+ when @Home was still alive and kicking. Comcrap throttled us back hard...and increased the monthly charge to boot.
