Ugh, think my city will pay for damages?

There is an access road around here running adjacent to the highway which provides access to businesses and homes off the main road. I was driving on a stretch of the road yesterday leaving walgreens. It's a section which is completely torn up and has been this way for a long as I can remember. There was a manhole sticking up waay above the ground. Normally I would have swerved around it however a car was passing on my left at the time so I kept going straight. It was also in the very center of my lane and would have had to have veered off the road to have avoided it so I just slowed down to about 5mph.

Well apparently it was raised above the road farther than I had thought and even though I had slowed down my car still hit. It caught the exhaust and tore a hole in my resonator. Not only that but it pulled it backwards and bent all the flanges causing a huge exhaust leak and a horrible noise. :| I started taking my exhaust apart to bring it to midas to have fixed when I saw this. One of the two support arms for my differential has cracked off.

I don't know HowTF that happened but I'm pretty sure it wasn't cracked before. It's possible that I've been driving around with it like that for a while but I doubt it. I'm pretty sure it's a result of that fvcking manhole. My friend says I may be able to hold the city responsible. What do you all think?

take pics of the protruding man hole and profit.

innuendo aside, take pics of said manhole and also take measurements.

again, innuendo aside, once u have the pics and measurements you can have a valid case. be sure to take a pic of the actual measurement (measuring tape or ruler to get the height of the manhole from the ground up)
 
Is your car lowered at all? If so, your chances of getting ANYTHING from the city are absolutely zero. That's their "out". "We can't be responsible for aftermarket modifications causing vehicles to sit lower than they were intended" etc. Even if you are at stock height, I would be very surprised if you got anything from them.

My car is dropped 1", although it seems like more than that. My ground clearance is almost nothing. I'm constantly dodging imperfections in the road that may cause it to scrape.

the resonator is leaning up against the diff. i think it knocked the resonator into the differential.

even if it didn't damage the differential it still fvcked up my exhaust pretty bad. none of the flanges line up now.

They will usually pay for it but it takes considerable amount of time, like a year or two before you get any payment. Make sure to document and photograph everything. It helps to get written statements from other drivers testifying to your claims of the road as well. Make sure to take it to a reputable shop (i.e. none of that Uncle Joe's muffler and donut shop), have them write a statement about the damage being highly probable from the type of incident you are suggesting.
 
a guy i used to work with busted a rim on some uneven payment in a construction zone. the city actually ended up paying for it. but it was a long process and a total pita from what he said.
 
You'll probably have to take it to court at the minimum. Collecting for property damage takes effort even though this country has embarassingly high rewards when it comes to frivolous personal injury claims.

Seriously...that was a really high manhole for it to reach up there. That would be like requiring a 4x4 clearance for something that high. How could you not notice it was that high??

Your differential I doubt was damaged by what you described...especially if you were going only 5MPH. It may have already been damaged but this was the final straw and caused it to break completely, but I doubt it did that all itself.
 
Dont forget the part that you hurt your neck really badly. then say that you just nned your car fixed and youll sign off on the injury.

Tell them you think you're sterile, too, and that you're pretty sure it's from all the stress you've suffered as a result of their sh!tty roads. That's sure to get you some pity points.
 
Wow, I got lucky. I was able to find a junk yard which had the differential housing for $75 + $20 to ship. Pretty damn cheap considering another place wanted $350 + shipping.
