U.S. troops face murder charges for Iraq killing

LOS ANGELES (Reuters) - Two U.S. Army soldiers are facing murder charges in a military trial in Baghdad for shooting and killing a badly
wounded Iraqi teenager mistaken for an insurgent by U.S. troops, the Los Angeles Times reports on its Web site.

They will have a fair trial over their actions. How is that bad? If they committed a crime they will be punished, if not, they will be exonerated.

That's what is supposed to happen, isn't it?

The incident isn't being denied or covered up. We still prosecute our own soldiers for possible war crimes, and that is as it should be.

Now, I have to say that I think they should be prosecuted. There is no such thing as a mercy killing except on TV, and if that is their excuse, no military tribunal is going to buy it imo.

There's no "mercy killing" defense in the UCMJ.

Under an executive amendment of the UCMJ Presideny Bush signed a couple of years ago, first-degree murder carries a mandatory penalty of life without the possibility of parole.

These GIs apparently made statements indicating they deliberately killed this guy, and one of them had to go get his M249 to do it - there is a real risk of them being prosecuted for first-degree murder and never seeing the streets again, which IMO would not really fit the crime. I'd like to see them prosecuted for second-degree murder instead, and serve a few years. We shall see . . .

I don't intend to marginalize the op, but I must comment, that I am shocked, with all the assertions of Iraq being such a failure, that there are garbage trucks running in Iraq, and apparently even in shifts.

It is interesting, but garbage service is a fairly basic public health and safety necessity.

A good friend is going to Iraq in a couple of weeks, and will be working in civilian clothes and living in an apartment in a large city there - I'll be curious what her experience is like. I'm afraid for her, but she is really strong, well-trained, and will be packing a Sig P228 (aka M8) and GAU-5, so hopefully all will be well.
