maybe when they arrived but they are no longer legally in the us so they are technically 'illegal aliens'
Just to be sure on what you are saying they came here legally on a permit of some sort, got a SSN, and now their permits have expired making them illegal? Yet, they still pay taxing on that SSN and INS hasn't done anything? Oh, wait, this is INS we're talking about. Never mind.
correct. and yes the INS apparently has no communications/connections with the IRS or any other govt agency.
that and there is no longer an INS. they are now a part of the dept of homeland security.
Ok then 🙂 If they pay taxes and what not, why don't they reapply and keep it all legit? This is why the government lumps them all into one category because it's illegal.
because it isnt always that easy. we have some pretty crazy standards for visas and they vary depending on the country of origin. some problems that i have seen are being out of school for a short period of time, unable to get a corp sponser, problems with immigration lawyers, etc.
my GF is currently going through the citizen process. Her residence card expires in May or something, however she started the Citizenship process a while ago.
the process is by no means cheap. I'm talking $500+. I think that price is one of the huge factors that stops these people from becoming legal. They typically don't make that much $$ in general and sometimes make $500 in 2 weeks.
i dunno for sure, but I think that is a factor in why people don't become citizens when their residence expires.
