I seriously doubt Intel could get away with such a policy, at least if it was publicly stated. Isnt it blatantly against fair employment practices to discriminate based on age?

As far as I know, the policy has been around and it's been very public. Justin Rattner (ex-CTO) knew about that policy as did every officer that Intel ever promoted. It's not like it just came up and Intel kicked him out as a surprise. I don't know the exact details of enforcement or the legality of it. It's just something that's been done for a while now.

They aren't forcing him to step down or retire, they are requiring him to change job titles and position.

If he chooses to retire instead of taking an internal position at existing (or even higher) pay then that is a personal career choice.

If it were to happen the way people paint it then yes, it would be auto-fodder for discrimination lawsuits. But it isn't lawsuit fodder because it isn't the way people want to portray it ;)

Company should allowed to have whatever policies it wants. He can be a corporate officer somewhere else if he does't like it.
