Trying to get out of a speeding ticket

I rarely ever get stopped going under 10, but I did today. I asked him about his calibration on the radar gun (also tuning fork) and he gave me some lip about how it is updated only once a year. I also asked to see the radar and how fast he did clock me at, he said he could not show me cause he did not save the settings. Should I go to court over this?

I read some of the good comments and some of the lame comments.

First of all, give me a break. EVERYONE does at least 5 over down here, I see people wizzing by me going well over 20 over.

I drive alot for my job, and I was tired. I had to drive a 5 hour ride and was leaving my grandpaws funeral. All I wanted to do was to get to my hotel to get to sleep for work in the morning.

But seriously, him not showing you the measurement might be worth debating; however, it will all come down to his word vs yours in that case. You can likely plead it down though.

You're supposed to save the Matlock routine for the courtroom. It's not going to help you with the cop, only hurt you. You might have gotten a warning if you didn't argue with him.

Yup. I do 78 in 65. I did that once and I didnt notice a cop was right next to me. I glanced at him and he looked at me and then I noticed everyone was slow as hell. I dropped back down to just a little above 70... whew.

The OP didn't mention his exact circumstances, but when people get speeding tickets it's RARELY about the fine, it's usually about the bogus implications that come along wtih it.
The sad fact is most drivers go over the speed limit at least sometimes, I bet you even have once in your life. The lottery style selection of who gets tickets and who doesnt leads to this attitude. If you got a ticket every time you went 8 over, would you feel you deserved it?

Second, and most importantly, this is usually about the insurance. Insurance uses these tickets to justify rate hikes under the pretense that because you were caught speeding you are a riskier driver to insure. For some people, this can mean a LOT. When I was young I got a speeding ticket similiar to the OP's and it cost me thousands of dollars a year because I was a young driver. In NY a ticket purges off your points record in 18 months, but insurance companies keep it as a determining factor for up to 5 years. 5 years. You could be paying more money for insurance in 5 years because of one ticket.

It's very easy to tell people to just slow down, but honestly, does the system make sense?

I worry not and don't speed, hence no need to buy a radar/laser detector. I'm glad NY has the law in gear to punish you idiots! Hmmmm..... Ticket/Idiot.... That a semi rhyme. Young drivers need to punished the most, as it may keep idiots like you in line.

I have to figure out how to fight my ticket as well. 74 in a 50(supposedly). Unfortunately the Colorado laws are against me. There is no discovery in traffic court and the rules of evidence do not apply. The only thing that needs to be determined is the speed of the vehicle and radar evidence is admitted if the cop has been trained on the radar, and the calibration was done with an appropriate test. Ive also read that getting the radar records here are useless as most judges wont allow them.

I dont know what to do at this point. I sent a request for a date change today (trial was scheduled for tuesday). My best hope is that the officer doesnt show up, but if that doesnt happen im probably screwed. Hopefully I can get some kind of good plea deal since its my first offense. Does anybody have any advice for dealing with tickets in this kind of situation?

In a 65mph zone on a highway, I do between that 65 and 70, never any more! I'm 33 and have never been pulled over for anything.

if you're not the "DIY" type, look for a traffic lawyer, they specialize in making speeding tickets go away

Where did I mention a radar or laser detector? And where did I say you worried? I said I bet you have went over the speed limit at times in your life.

And why are you calling me an idiot? How did this become personal and vindictive? Your anger at the OP and me is unwarranted. We disagree on a point, but how does that make me an idiot?

I'm not familiar with your posting on here but if this is par for the course you should have been vacationed a long time ago.
