Just doing some work for law, and I need to find 5 laws/acts I think are good, 5 that are bad.
For bad I've put Double Jeopardy and Access to Education Act.
Here's my justification for double jeopardy:
In my opinion, Double Jeopardy does have its obvious positives, but the negatives outweigh those which are positive, ergo a bad law in this context. In the event someone is proven not guilty in the highest court, they are unable to appeal the decision, and based on double jeopardy it is also not possible for them to try their case again. In the event someone were to be proven not guilty, but in the future new evidence was found which could tip the balance of probability in the favor of the prosecutors they would be unable to retry their case based on the double jeopardy law.
One of the possible solutions to this problem would be to allow for all cases which end in acquittals that have ended in the Supreme Court to be given one opportunity after the case has been done to plead their case if they choose in the future for a retrial based on substantial new evidence, in the event they were successful in earning a retrial they would have one chance, and one chance only at a conviction. Regardless of what the verdict were in the retrial, they would not be permitted to ever retry the person(s) for the same conviction(s).
If anyone can think of any laws which they think are disputable etc and why, and can post it I'd appreciate it a ton. For good all I have right now is the anatomy act.
Preferably Canadian laws, but States laws will work if I cant find my 5 in canadian only.
