The law doesn't appear to be clear cut. But commercial use of the president's picture that creates a misleading narrative appears to be illegal. However, using the president's picture in a communicative manner (for example, criticizing, praising, etc), would most likely be considered a first amendment right.

For example, the picture in the ars article would be protected speech.
