Even if you're not speeding but coasting, a car coming out of a side street leaving you nowhere to swerve can still result in you hitting them. It simply depends on how much time you were given. I'm a defensive driver too and thought what you did, but there's not always a way out. This is why "I'm a good driver" means jack when there are other drivers on the road with you.

Just have to make sure he wasn't texting or on his phone, then the Prius girl is fully at fault. If phone logs show him doing so though... that could be a problem.

I would suggest you take it easy and be cautious. Some injuries can remain hidden for a long long time before manifesting themselves. I had mountain biking accident that fucked up my left scapula, but it did not show up a month after the fact. My GF was rear ended and had chronic neck pain for almost a year, but the pain did not appear until a few weeks after the accident. Be very cautious if either of the insurance companies try to get you to sign any sort of medical waiver since you seem fine now. You may be fine now, you may not be a few weeks from now.

Doesn't matter if his eyes were closed...the Prius had a stop sign. If you have a stop sign, you stop until you are clear to go. If you have a stop sign and you pull out into traffic and get hit, it's your fault unless they didn't have right of way. As mentioned earlier I could see some contributory blame being assigned, but if an insurance company told me they wanted to go through my phone, I'd likely be telling them to pound sand. If on-site law enforcement says it's the Prius's fault, that's quite likely what the insurance companies are going to go with.

When I got into a similar accident (minus the stop sign), the cop told me that the other driver was at fault. She pulled out of a parking lot and I was passing stopped cars that were turning left at the stoplight up ahead, so there was nowhere for me to go. He told us that it wouldn't matter if I was doing 80mph (in a 30mph zone), she cannot legally enter the roadway unless it is clear. Her insurance still sent me paperwork to fill out, but I ignored them (based on advice I read online, you should only communicate with your own insurance company and let them handle it). Nothing ever came of it. I didn't pursue it cause my car was a junker already and still ran fine afterwards and I'm not a scumbag.

Maybe you might be missing the point here.

You heard of the saying, "you are right, but dead right" meaning that it pays to be defensive and play it safe.

I was not there and I will not judge anyone. But a general rule in life is always to play it safe no matter how "right" you might be. Look at all the hassle he has to go through now.

Of course, sometimes there is nothing a person can do to avoid an accident due to circumstances. In such cases we can only hope for the best and endure the horrific situation as best as we can.

I have. I was going 30 in a 30 and the other dude was going 50 and made a left turn straight into me. I had about a quarter second to react. I actually made the split second decision to dump my car onto the curb because someone veering straight at you at 50 is terrifying. Not like oh he veered a little bit in the oncoming lane. I'm talking straight-at-me. It was $5k in damage to go from 30 to 0 via curb and the other guy ran. He turned left and I had to veer right to avoid him. Thats how you know you have almost zero reaction time. You know those times that someone turns left infront of you and you non-nonchalantly go to the left defensively as well just to make sure he makes it? Yea that implies you had plenty of reaction time. Tridents only options were to veer left (because she popped out at him from the right) and he stated that there were cars to his left. Trident is 100% in the right.

So I want to stand up for the right thing and actually let you guys know that trident did the correct thing. As far as insurance goes your best bet is to actually just brake as best you can when you have the right of way instead of trying to have super reflexes and prevent an accident.

Reason # 238945728375 this board has become a bunch of drooling morons though.

No, you brake and hit them dead-on like the car was designed to do. Doing crazy swerves is far more dangerous.
 
Glad you are generally ok bro. I was the passenger in an accident like that once, but we were the car hit; kind of scary.

All the stupid political toolbags aside, I hope you're doing well TridenT. I'm pretty lucky I haven't been in any major wreck yet....

Most I've had is one happening right next to me. I was in the right lane, some moron in the lane next to me in a shit car starts veering into my lane slowly...but before I could even honk my horn at him he realizes oh shit, I should check my mirrors/blind spot DURING the lane transition instead of before and see's I'm already halfway/mostly in the side median right next to him. He immediately VEERS his wheel to the left and his car spins out.

Next thing you know, his car is sitting there in the left 2 lanes or so (mostly in the 2nd to the left at 90 degrees and an SUV comes and PLOWS him on the side. It's funny because the car that flipped and did a couple spins was actually the SUV. I just sat there in completely shock knowing I could have been involved there... Not a single scratch on my car. 😱
 
Glad to know you're ok OP. Had a few close calls myself, and for some reason, the local wildlife doesn't seem to follow the laws. Given how cheap it was, comphrehensive was a no-brainer. Collision coverage however, after weighing some odds, did not justify the high price.
