Get a lawyer and say you have mental anguish and you are traumatized. I hit someone and it broke my fog light.. the bumper fell off on her car. Sued me and got $85k... just sayin' if you want to be a pos you can make $.
 
I hope the girl has up to date insurance because around here, many many drivers are driving around without any insurance or they did pay a month to get pass inspection and then cancelled insurance by not paying anymore.

Per The Google, 12% of drivers in CA don't have insurance, or one in eight. I think that figure is roughly true across the country. Basically if you drive and can't afford to replace your car with your own assets and income, get comprehensive and collision coverage as well as liability. Especially before you spend oodles of money on trivialities.
 
I'll be seeing what I can do to get compensated fairly. My doctor prescribed some stuff. I got x-rayed. I'll be taking it easy for the next week. It'll get worse before it gets better and symptoms might manifest well after the fact.

Talked to both insurance companies.

Apparently I have a lot more than just liability on my insurance... I mean, a lot more. So, that's interesting!

Yeah, it is. I thought I just had liability but apparently the plan I was on was not just that. So, that clears that. I'll be able to get medical compensation from my company if the other doesn't pan out for some reason. (Mine shouldn't have to pay for shit)

Driver of Car A is at fault. End of story.

Side note - shame on those of you suggesting he fake pain or worse. That's downright dishonest, borderline fraud, and you're likely part of the reason why insurance costs as much as it does. Knock it off.

yup... I was in Car A's position in an accident when I was like 20. didn't matter that the only reason Car B hit me was because they were going 50 mph in a 25 zone and I assumed that I had time to clear the intersection, I had the stop sign so it was my fault period.

I lucked out because the other driver was uninsured, so I never had a claim filed against me.

Not entirely true. If he had been found to break the law in some other way that affected the accident such as racing, speeding, DWI, no headlights, or something he could have been found to be "contributory". Most states allow you to sue for a percentage for instance if she was 80 percent at fault he can only file a claim against her for 80% of his damages. I imagine she could turn around and try to sue him back for his 20% of her costs.

Here in MD it's different. There is none of that divvy up blame BS. You've got to prove you had ZERO fault as was ruled for TridenT. If you are 1 percent at fault you have no claim. Theoretically if you want to get paid for an accident you'd better drive perfectly all the time so you can't even be blamed for 1 percent. It doesn't work we all drive like assholes.
