For the record, trespassing is NOT a capital crime. I cut the following quotes from another thread. Unfortunately, the thread was locked while I was refuting potentially tragic misinformation. (This was a side issue to the original thread. I hope the mods find it acceptable. If not, I apologize.)
Perhaps you live in some rural backwater with a redneck sheriff who looks the other way if you off some "troublemaker". If so, next time you see him, please share my contempt along with my sincere hope he is imprisoned soon. We have too many other yee-haws in this country who feel entitled to take the law into their own hands. If he's not willing to enforce the laws, he has no business in law enforcement.
On the other hand, perhaps your sheriff is a great cop and you're just blowing smoke. Either way, if you catch someone trespassing on your land, your legal recourse is to call the police and file charges -- trespassing charges. If you shoot him, you may find yourself in a cage exploring your sexuality with a guy named Bubba. Trespassing is not a capital offense.
Edit: I stand corrected, at least to a point. It appears it may be OK to kill people in Texas if they trespass at night. Yee haw!

Damn right you can. We have had problems with people trespassing(poaching) on our land before. Both the local Sheriff and Game Warden have told us to just shoot whoever we find there if they are there without our permission.
