Legal gender and genetic gender are 2 different things.

You are born with a genetic gender whether you like it or not.

If you don't like it, than you can alter your appearance and legally change your "societal" gender.

But you are still genetically what you were born as.

I stopped reading there. Someone who is born a woman is not a man, so I figure the rest of the article is filled with similar lies.

He will probably win. Sounds like the center didn't do enough verification before firing him. He applied to a job as a male and produced gov't documents indicating he is male. The center received information that he might be female. The center questioned him and he invoked his right to not discuss it.

At that point the center had an indication that someone hired for a male-only job (a legal job classification) might not be a male. There was at least some evidence that the government documents provided to prove his "maleness" were counterfeit. He refused to discuss the scenario.

The center then took the preemptive move to fire him. At that point they had an unsubstantiated claim that he was not male. They took the testimony of a random person over the validity of the documents produced, with no evidence to disprove the documents.

Had the center done further investigation and gathered proof the person was born a female, then the validity of the gov't documents would truly be in question and his refusal to speak on his behalf would give the center basis for firing him.

As it is they acted hastily and will lose.

You can't discriminate based on sex and if i remember correct after a sex change operation you are legally the sex assigned to you by surgery. i.e. penis = male/no penis = female type thing.

So I would say he has a real good case based on what little has been said.

The whole thing is fucking stupid and here's why. The job requires the person to be male. This implies they want a heterosexual male since the job involves watching men pee. But they can't by law require a hetero male or inquire as to the applicant's sexuality. So what's the fucking difference if a hetero woman undergoes a sex change to become a gay male vs a gay male legally holding the job?

The job is to make sure people don't cheat the test. Your sexuality does not affect whether you can perform this job.

I also don't believe there are gender specific jobs like, there's plenty of women who work in healthcare facilities where they have to see men do things in the nutty. It's like saying men can't be Gynos or something. Or a woman who used to be a man can't be a Gyno because she'll probably just poke around for fun.

At first that is the way I thought. But because he did not disclose his change means he also did not disclose any previous names he lived under. So no background check could be done to reveal his or her true background. For that you can be fired. And some things from your past can disqualify you for certain jobs. So this will be a tough one. When I thought along the lines of just employment, no doubt his application was not entirely truthful.

With a background check, you have to provide your SSN and that is harder to change than your name. the SSA will only change it IF you can prove your number was stolen and being abused by someone other than you.
