Transgender Man fired for not being a man

This will be a case to keep an eye on. He is fully transgendered and he got a job a drug testing facility watching men doing their urination for drug screening. Someone found out he was born a woman and when questioned about his change he refused to answer questions, so he was fired. Now legally he is a man I believe, but I wonder if there was anything on the app like some I have seen where they ask you about anything that may hinder or affect your ability to do the job. It is a male only job, which does make sense. Very interesting case.....

You can't discriminate based on sex and if i remember correct after a sex change operation you are legally the sex assigned to you by surgery. i.e. penis = male/no penis = female type thing.

So I would say he has a real good case based on what little has been said.

How come I haven't seen Mike Rowe doing that job yet on Dirty Jobs?

BTW in my state that employer's action would be clearly prohibited under our state anti-discrimination laws.

Just because you mutilate yourself, doesn't mean you are a man.

while i don't agree with your method of delivery, i agree with the opinion. barr hermaphrodites, you are what you were born. in the next 20 years or so tech may move to the point of being able to actually turn a male>female or vice versa but not now. now, it's only surgery

Its simple science.

So we have some "progressive" government policy stating that a woman is a man and a man is a woman. What happens when a "transgender" person commits murder. They have behind male DNA but in the system they are a woman.

Hey, I always felt like a dolphin on the inside.......

I have to agree with Patranus on this one... Its like when I saw Oprah advertising an episode where she was interviewing the first man to have a child. No, its a WOMAN having a child who had a sex change to become a man. That doesn't make "her" a MAN.

Since it's a matter of employment, what should matter in this case IMO is whether the person is legally considered to be male or female. Not what chromosomes they possess.

I agree with Theb and Throckmorton.

I would be more comfortable with a heterosexual male watching me urinate or a lesbian. In either case, I do not want someone watching me that wants such a job.

I am not familiar with sex-change operations, but I have heard that in several cases (for woman -> man surgery at least), the person undergoing to surgery can elect to retain their "working" reproductive organs in case they wished to have children one day. So, how does one classify the gender of such a person? Legally a man with a working female reproductive track?

Then we need to debate what makes someone a man vs a woman.

Does having a penis make you a man?
Does having a vagina make you a woman?
Does having testicles make you a man?
Does having ovaries make you a woman?
Does having a womb make you a woman?
Does having a Y chromosome make you a man?
Does the M on your license make you a man?

External genitalia does NOT dictate your gender, although it is a pretty damn good indicator.

Any 5th grade science student can tell you that if you have XX chromosomes you are a woman and if you have XY chromosomes you are a man.

Its not rocket science, except to the feel good "progressives" who have to over think everything.

At first that is the way I thought. But because he did not disclose his change means he also did not disclose any previous names he lived under. So no background check could be done to reveal his or her true background. For that you can be fired. And some things from your past can disqualify you for certain jobs. So this will be a tough one. When I thought along the lines of just employment, no doubt his application was not entirely truthful.

Wonder what p'anus will have to say when science makes it possible to swap chromosomes. He's playing god of the gaps and it's a losing battle.
