Town manager fired for marrying a pornstar

Janke will get a severance package worth six months salary, which comes to about $50,000, plus health benefits.

Janke said he and his wife were married in October and are taking care of their three teenage children. He wouldn't comment on any possible legal action against the town.

Kiker acknowledged that Janke had violated no rules or laws and added that he had done a good job for the island town that had about 6,500 people, according to the 2000 Census. But the mayor was concerned whether Janke could remain effective and not distract the community from the business of the town along the state's west coast.

"One of the reasons we brought him here is that there were some divisive problems on the beach," Kiker said. "We wanted him to bring people together."

Councilman Tom Babcock, responding to residents' questions, said at a council meeting Wednesday that Janke was fired because his wife's profession brought an inaccurate image to Fort Myers Beach, according to the News-Press of Fort Myers.

"When you become a public figure you are held to a different level of scrutiny and ethics," Babcock said.

Janke said it's too early to think about what's next.

"A termination on a resume does not look good, no matter what the reason," Janke said.

Janke began working for Fort Myers Beach in March 2008. He has also worked for the City of Marathon in the Keys and for various local governments throughout Alaska since 1989.

I am quite surprised that they didn't ask him to resign. Regardless of what his contract says, I think they probably just opened themselves to a lawsuit.


At will state and on top of the the contract said if they have a majority vote he can be removed without cause at anytime.

So I don't agree with them but I can't think of a law they broke that would stick in court, and/or hold up on appeal.

I can't think of a law they broke either, but since when has that stopped people from suing? 😛

Suing in civil court is different than pressing charges of illegal firing. Just because it is an at will state, does not mean they can fire you without just cause. In this case discrimination can be easily proved.

It's akin to firing someone becaue they married a black person and you don't want your town thinking you approve of blacks.

Race is a protected class, being a porn star (or married to one) is not. Town/City mangers have many clauses in their contract they can be let go for. He can sue all he wants but the town did not break the law and/or any rules for employment and he would lose.

While they had the right to fire him, really sucks. Personally, I wouldn't give a shit if the guy did the job well...but that's just me.

there are probably limits to firing people "without cause" esp since they've already admitted publically their petty reasons for doing as such. i doubt you could claim you are just fine under the "without cause" bit if you publically admitted you fired someone because they married a black woman and that would upset your community.

His firing came, what, 6 hours at most after they learned of it? Nope, no judgment call there, plenty of time to discuss the ramafications of a marriage. Also, it's a matter of how effective he becomes after this situation? The situation of you firing him? My guess is not very effective.
 
While i feel for them, I don't see how someone could marry a porn star, maybe its my age (21), and you grow to not be so concerned with things like that.. Something i can't wrap my head around at the moment though!

Did you read what you posted? You just backed up what I already posted.
Being married to a porn star is NOT a protected class. Then on top of that his job is contract based. A simple majority can remove him at anytime for any non-protected reason.

I do HR at the Fed level. Trust me I know what we can and can not fire people for.
He can sue if he likes, but he will lose.
