My dad just gave me this newpaper article from the Baltimore sun.

Is it me, or is this a blatant violation of our 4th(i think that's it) amendment rights against unlawful search and siezure? It essentially amounts to company being founded on the basis of providing a hacking service. It's not enough that they shut down napster, now they have to go for the users. They do have one very weak link: They are relying on the ISP's to deny service until the file is deleted. That's like saying to them: "hey why don't you cut your profit margins by a considerable figure." Yea i bet they'll go for that.

There should be some law against that software searching your harddrive.
Thats like breaking into a house through an open window and reading the persons credit history, then reporting it to the credit company so they shut off your cards.

I saw that in today's paper. Sounds like a good reason not to use Napster anymore. I hardly ever used it in the first place (mainly to find a song when I wasn't exactly sure what I was looking for), & only have a few (certainly fewer than 10, probably fewer than 5) MP3's that I don't own the CD for.

However...

I do have ~30 CD's worth of MP3's on my HD that I DO own the CD for. In fact, I ripped them myself for the convenience of having them at my fingertips. If they cancel my ISP account for a song that I own the CD for, I'll call the police & request that they document my entire CD collection. Then I'll take that to my ISP & demand that they re-instate my account.

Yes I know the 4th amendment exists.
But govt. does not move a fraction of the speed that the technology industry does, which presents problems, like this one.

If they shut off my isp access, I would be rather angry.
Regardless if they found a file or not that was pirated, they broke my basic rights.
And I would bring it all the way to court as well.
I know not ALL the music I have is legit.
But, they have to prove that with due process.
With a search warrant mandated by the courts.
BS if you ask me.

I'm told by a friend that this type of thing has happened before, and that the companies were shut down because it was illegal. I'm gonna look for where he saw it but i don't think i can find it. It's times like this that i wish i was a hacker

Zone Alarm won?t do a thing against this. It?s a bot that runs on Napster?s network. Your nap client did all the searching of your hard drive for them and shared it along with your username and IP to Napster?s server.

Incidentally, running a bot of your own on Napster will get you banned too. . . Hmmn.
