My fiancee leased an apartment before I moved to Raleigh. It is a one bedroom because that is all she/we could afford at the time. She leased in June so everyone at NC State was also leasing apartments which inflated the price.

Well not since i am moved here we need an apartment that is bigger. Not big deal right? Wrong. We have to give two months notice if we want to vacate regardless when the lease runs out. Our lease is up June 7, so by April 7th they have to know if we are staying or leaving.

That creates quite a problem. We can't afford to pay rent at two places for two months. That would be an extra $1200 spent that we don't have. We might be able to wing it if the notice was 30 days.

We found a place we love that is only about $50 more than were we are currently staying. We talked to them about it and they said by June it will have increased by about $200.

Basically with the 60 days notice, I have to decide to chance not having a place to live by giving notice to vacate or continue living in an apartment that is entirely too small with the possibility of rent increasing. We talked to our complex about possibly transfering to a bigger apartment here but they want $100 more a month than we can afford.

The situation just sucks.....

Yep it sucks. The places I'm at require either 30 or 60 days and then you'll probably end up paying a month on top of it. When does your lease end? I'd just run it out if I were you. You can handle a one bedroom - mrsskoorb and I spent 18 months in a bachelor apartment. No kidding. One bedroom compared to that is a mansion.

in cali, you only need to give 30days notice. check the laws in yours state to make sure you're not getting the shaft. as for apt complexes and their management, i HATE living in one, but i'm forced for in the meantime because i can't afford a house yet. i've gotten jacked so many times from apts, stuff like taking ridiculous amounts from the deposit upon moveout, car parking problems, stupid ass neighbors..etc. it SUCKS.

What really sucks is that even when our LEASE IS UP we have to give 60 days notice. If we don't give notice that we are leaving then our lease goes into a month to month lease and to leave you still have to give 60 days notice.

That is why we are screwed. Even if we let our lease run out we have to give 60 days notice. The lease is up June 7th.

The one bedroom has worked only because it has had to. We want a two bedroom because right now we can get one for about the same price we are paying now. If we could just let our lease go to month to month later then give 30 days notice we would just chill here until next Feb so we could get a cheap price on rent. The problem is no matter what we do, we are stuck with the 60 days notice.

really depends on what you signed.

What does your lease agreement say?

lease I am in now is a 2 month notice and it actually gives the dollar amount, roughly 2 months worse that you forfeit if you break the lease. I'm in Durham county

I just went through exactly the same thing, we were looking at buying a house though. My wife went in and asked for a letter stating we had paid the rent on time for our 3 year tenure at the apt complex. This was a bit over the 60 day notice period, about 70 days...so they knew we were looking. We got final approval for the mortgage at the 40 day mark and turned in our notice at that point...they initially tried to get us to pay for 60 days. Our lease ENDS Mar 12, we were not trying to leave early, yet they still tried to get us to pay the whole 60 days, which would have been 18 days for an empty apt.

I went to their Eastern Regional Customer relations rep, and it funneled down that since we had been model tenants, no complaints etc, that we could leave when we asked to. They had us legally since it was in the original contract we had signed...but they finally folded when I brought up the various facts that had contributed to a late notice.

Don't give two months notice. Move out now, get the place you like, and forfiet your current security deposit.

Actually we didn't pay a security deposit. We had good enough credit and references that they didn't require one :)

Since it is in the lease that if we break the lease without notice we owe two months rent then that could go on our credit report. So just leaving whenever we want is not a good idea.

My fiancee doesn't like my idea but I personally think we should apply for a loan to buy a house. Find some cheap house for around 80,000 and take advantage of all the programs for first time home buyers. My fiancee is going to be at NC State for 4 more years getting her PhD so paying rent is stupid in my mind. The main problem is that I don't have a job so our only income is her stipend which is roughly 19K/year.

Well it was my fiancee that had the good credit. Mine is not that good. She signed the lease before I moved up here. What will probably happen is we will just give notice and take out chances. Maybe Anand will let us move in with him when we can't find an apartment under $600.
