BELEN, N.M. ? A 10-year-old New Mexico boy is facing a murder charge in the shooting death of his father.

Police alleged that the boy used his own rifle to shoot his father and then called authorities. Arriving at the family's home Thursday evening, police found 42-year-old Byron Hilburn with a head wound. He was pronounced dead at an Albuquerque hospital.

The youth reportedly told officers that he thought his father was disciplining him too harshly and too often, according to KOAT-TV.

Local media, in weekend reports, said a first-degree murder charge was pending against the boy. There was no comment Sunday from authorities. A dispatcher taking messages for the Belen Police Department told The Associated Press that spokesmen were unavailable until Monday.

Police said they suspect that the shooting was witnessed by the boy's 6-year-old sister, who has since been placed with relatives.

The boy is in the custody of the New Mexico Children, Youth and Families Department.

Hilburn was divorced and had custody of both children, police said.

Though neighbors said the family seemed normal, the state agency responsible for protecting children had been called about problems in the home.

Romaine Serna, spokeswoman for CYFD, said the agency was called to check on the family more than seven times since 2003 after receiving anonymous reports of child abuse and neglect.

"We had concerns about this family. There were red flags," Serna said.

But the agency interviewed family members, close friends, school officials and doctors and "not one of them had concerns about this household," Serna said.

Serna said CYFD didn't have enough evidence to remove the children from the household.

"There were no bruises. There were no marks," she said.

Next-door neighbor Elaine Sanchez said they were just "regular neighbors that we used to say hi and bye to."

Sanchez said her daughter played with the 6-year-old girl.

"We live just a few feet from them. My little daughter likes to go out and ride her bike and now I keep thinking, 'What if she had been hit, too?' " Sanchez said.

Belen is 35 miles south of Albuquerque.

I hate to ask this, but why wasn't the gun secured? It may have been the kids, but it should have been lock up when not in use.

none of my dads firearms were locked up when i was a kid. they were all in a gun cabinet or a closet, but not locked up. i was taught gun safety and never messed with the weapons without supervisions. i never wanted to shoot my parents.

now...i wanted to kick him in the nuts every now and again, but really, what kid hasnt wanted to do that?

My father was stabbed by my older brother; thank god he didn't have access to a gun or my father wouldn't be alive. There was no abuse, but he got off Scott free because his attorney simply accused my father of such. Granted, for this instance it's possible he was being abused. There's plenty of ways to do it without leaving bruises so people will probably never know for sure one way or the other.

It wasn't 'not in use'. Quite the contrary.

I don't think the gun nuts on the forum should have an issue with this. A gun is a machine designed to kill, and that's what the kid wanted to do. He used the tool and it worked.

Obviously Bush's allowance for violent video games, torture-porn movies, and emo music, have all played an intricate role in this youth's life... culminating with him imitating what he has seen so he could live the way he wanted to. Typical Americans - do what they want with no concern for others, especially if others are preventing them from doing what they want.

as someone who was once I kid... I will argue, kids are evil. 😛

How evil a child is, is simply determined by proximity to other evil children. Children have 1 mode - evil... but it has a range of values. From 0 - neutral, to -9999 - basterd with gun.

So, if a kid surrounds himself with friends who are relatively close to 0, well... when together, they're evil score will drop quite a bit, but return to their normal value when separated.

But if a kid surrounds himself with those who have higher evil values, there scores won't change too much when together, because they likely helped shape each others scores anyhow - but, the kid who has a lower evil value, well... his is going to keep rising red when around those friends, and when alone, will maintain a relatively high value.

Based on the information in the article, it is theoretically possible that the father was an abusive asshole and the kid did the right thing. Not likely, but possible.
