Hard to say. the eckard goofball turned him in, but it was the DA that got him the jail time. I could almost handle 6 months in jail, but missing six months of my childs life... damn.

Your bolded statement would land you in jail because you have no supporting evidence whatsoever for that claim. It would also probably land a civil suit at your door. (PS I know it was a joke 😉 )

The Eckerd's employee, as a photo technician, was probably bound by terms of employment to turn this guy in. It may have even been law for the employee to turn him in. Nothing would've come of it if not for the assinine DA.

The LEOs simply handled the call, and obtained the evidence. It was up to the DA and the higher-ups whether or not to prosectue the family, not the LEOs.

Would you want the LEOs to simply throw the pictures out because they "thought" there was nothing going on. It's their job to investigate and see if a crime was committed.

Im all for protecting the innocent and children who cannot protect themselves. But WHY do we lock up a loving father for 6 months when we let convicted multiple offense child molesters outs of jail repeatedly?

You do know what child pornography is, right?

The photo technician was just doing his/her job. It was up to the county whether or not to prosecute, and they made the wrong decision. Which is why the county and DA should be held liable, not the photo technician who was probably bound by law and employment terms to turn this over to police.

Nobody wants to take responsibility for using their brains to make a rational judgement on anything.

But considering how liability has gone, that's really no suprise. Considering the sue-happy nature of our society (just look at this thread :roll: ), is it any wonder that any official is unwilling to put their ass on the line by making an actual decision? Much easier and safer to run it through the process.

The baby was naked. I can see how a photo from a poorly chosen angle might raise questions. But at some point early on, somebody should have made a rational judgement about it and not dragged the family through hell without additional evidence.

It's tough to tell without the full story.

- Hamaty is an illegal immigrant. He failed to renew a work visa years ago.
- The photos in question do not show the infant son getting a kiss on the belly button, but on the penis, from both the father and the 6 year-old daughter. Supposedly, there is some type of cultural issue involved, and no criminal intent, but it does make the police and DA's actions understandable.
