SYDNEY -- Sports? highest court Thursday dismissed the appeal of Romanian Andreea Raducan(bio), who had her Olympic gold medal in the women?s individual all-around stripped by the International Olympic Committee (IOC) after testing positive for a banned substance found in cold tablets she took.

Hours later, Ion Tirac announced he would resign as head of the Romanian Olympic Committee to avoid having to impose his own mandated lifetime ban on Raducan for failing a drug test.

The IOC had no choice. Unfortunately, she is a victim of the war on drugs. And how good would it look right about now for them to get soft on drugs when almost every Olympic story mentions drugs?

Also, they'd have to give a slew of medals to other athletes who were disqualified under similar circumstances. Rick DeMont lost his medal after he disclosed his medication to the USOC and USA Swimming. They failed to identify the ephedrine in his doctor prescribed medication, it was detected in a drug test, and he lost his medal. He was royally screwed by his own federations!

They did the right thing in this instance, but they need to change the rule and allow doctor authorized minimal levels of some drugs when they are known to be non-ergogenic for that sport. The gymnast did not gain any ergogenic benefit from the drug, thus she would have gotten her medal under such a rule. Perhaps now the IOC will thoroughly review their drug policy and procedures. They also ban marijuana for instance, even though it has anti-ergogenic properties. The real irony is how they appear to be in the business of legislating the athlete's morality, but many IOC members have in fact taken bribes and excessive perquisites. Ah, "consistency, though art a jewel."

The team doctor did disclose that she was taking Nurofen, and listed it on the form. Why would the IOC let her take it if they knew she would be banned later? They are trying to correct their public image by going on a witch hunt and taking no prisoners. It's just a shame they couldn't do the same with their own bribery scandals.

I wouldnt take much drugs besides nyquill or dayquill for a little cold. Unless im really sick i'd just a get a prescription from a docter. Practically all the athletes take some kinds of supplements , ya never know when an illegal substance is found in it.

Romania also gave back it's two other medals in protest; I'd hate to be the two people that rightfully won those and was told to give them back for your country.

She was given the med during the competition by the doctor, allegedly. No forms were filled out. But here's what really occurred: The girl stupidly took the medication for her cold without thinking. It contained pseudoephedrine, which is a banned stimulant. When she came up with a positive drug test, they blamed it on the doctor in the hope that the IOC would exonerate her. Believe me, these are very tight teams. The doctor was perfectly willing to be the fall guy because he loses only his right to be the team doctor. He can go back to practicing medicine. But the girl loses everything she worked a lifetime for because she slipped up and took a simple cold pill! The IOC saw right through this ruse, but even if they hadn't it wouldn't have mattered. Until they change the rule, zero tolerance for drugs is their stated policy.

Interestingly, the active ingredient of DayQuil is pseudoephedrine, the very drug this girl was busted for. Pseudoephedrine is also the precursor chemical for making methamphetamine.

Yup. And that just underscores how easy it is to run afoul of these drug rules. One little slip and you go from millionaire to national disgrace. Although, in this case, the girl is being treated properly-as the unfortunate victim of IOC intransigence. I really feel sorry for the kid.

Women's gymnastics would have little difference if you took psuedoephedrine. They are based on precision and skill, not on strength.

Matt Shirvington of Australia and Donovan Bailey of Canada didn't make it very far due to illnesses, and both had to refuse any medication for fear of a ban from competing if they had a positive drug test. Shirvington even threw up after a race.

Anyone notice how the focus is now on the drug tests and everyone forgets about the IOC's own problems? If we're going to clean house, let's clean house!
