Theoretical question...

So I have a torn ACL and meniscus. Also some cartilage damage. Im going to be having surgery in the next week or so. Obviously right after the surgery I'll be unable to walk or anything for a couple weeks.

My question is this:


I currently work at Circuit City (I know, it sucks balls) and my manager is an asshat. The doctor basically told me I shouldn't work, and said that the company shouldn't want me to either because of the fact that I could injure myself further at work and workmans comp crap.

Well like I said, my store director is a total asshat, and he will tell me I can come in and hobble around on cruches. Now don't get me wrong, I want to go to work... I need money, the only reason Im even ok is Im good at saving money and have like 3 grand in the bank. But the thing is, Im seriously limited in my mobility. I can walk on my knee very short distances, and its more of a major limp than a walk. I can't do much bending of it at all, and after much movement on it it gets very sore very quick. So in short, it would be painful to work, especially the long days that Im normally scheduled (10 hours plus). My manager is going to tell me I can anyway yatta yatta, so my question is this: If the company insists I come to work, can they be held liable for me injuring myself further (or just being in severe pain etc?). I'm not sure they could be held liable if I don't actually injure myself at work, but just aggravate it. Especially since technically, I came in on my own will?



Also, does anyone have any suggestions on what to tell my asshat manager when I have to tell him I'll be unable to work for a couple more weeks?

If you innjured yourself at work the company's workman's comp carrier should be paying the medical bills and you should be receiving workman't comp payments while you are unable to work. It is entirely up to the doctor to tell you when you can go back to work, not your employer or you.

You take a little chit from the doc that says "No work by xx weeks" and give it to your manager. What can he do? And yes, that would put the liability issue in his lap.

negative. Although I usually work 40 hours a week, Im only considered part time.

CC has health plans for both their FT & PT employees. If you're working 40 hours a week as a PT employee, all the more reason to call HR in the AM

If you're asking yourself "who the hell is Aron Ralston," you'd better step back and re-evaluate your life right now. Ralston, the living legend, was hiking up a cliff in southern Utah (probably to do something manly like take a leak off of it), when a giant boulder fell on him, pinning his arm against the ground. Most people would have just died, but did he surrender his life to a mere giant life-threatening boulder? Hell no. He just kept getting angrier and angrier until he finally CUT OFF HIS ARM WITH A DULL KNIFE. Since I don't have any credible sources of what happened next, I'm going to go off of the next best thing: hearsay and rumor. After he cut off his arm, he jumped off the cliff and broke his fall with his face, just because he's that tough. Then he got ambushed by a tribe of angry Indians, caught an arrow in his heart, pulled it out and killed all the warriors with it. On his way back a buffalo crossed his path so what did Ralston do? He head-butt it to death, then he found its offspring and broke their ribs just for pissing him off. Then he chopped down a tree with his undoubtedly large penis, built a raft out of it and rafted down the green river. That's the damn truth--more or less. Aron Ralston is a real man and one tough son of a bitch. He deserves utmost respect for being such a badass.

wow so they want you to work full time hours while only considering you partime, on an injured leg. You really should contact HR, as it's their job to handle things like this and keep certain people out of legal trouble.

Well, normally Im fulltime hours. There are times when Im around 30 a week (minimum) but most weeks, especially during holiday seasons (which is understandable) Im at between 37 and 40. Including the last couple weeks before my injury. As it is now, I don't know what kind of hours they want me to work, but I would imagine most of the same.

Cuda1447, no personal offense meant, but IMO it looks like you are fishing for a way to have CC pay your medical bills since you did not opt in on their PT health insurance; either that or you're looking to sue them for something related?

None taken. Actually though, thats far from the case. I have health insurance, Im not worried about that in the least. What Im looking for is something I can tell my manager to get him off my ass about coming into work. Such as, "Well, I can come in but if I get hurt more, you guys will be held liable for it" and more than anything, just wondering.


I had no need to enroll in the PT health insurance because 1. I didnt realize they had it and 2. I still live at home, and am still under my parents health insurance.

When I first hurt my knee I called him the next day and let him know. The day after that I called him again, telling him what probably happened and what the doctor had said (which was to stay off of it until further notice, and further notice would be a week since that was my next appointment). At that point he gave me a buncha sh!t about it. I told him I had a doctors note, and he told me that it had to say specifically this or that. Basically a buncha BS and saying that the note I had wasn't good enough, cause it didn't say I was unable to work, just that I shouldnt. He also told me I could come in and sit on a stool.


I was like wtf... how am I supposed to perform my job (which involves moving around, talking to customers, lifting things from time to time, as well as bending down to unlock items etc..) when Im unable to walk on my knee at all, let alone bend it or have any decent range of motion. All in all he just gave me a real hard time about it cause he's an asshole like that.

just one thing i heard-

a friend of mine has a dad that had a kidney disease, snyders (i think thats the place) laid him off cause they didn't want to pay the workmans comp or the insurence or somthing, anyway they tried to fight it... the company filed in nevada (we're in MN) so they would have had to go all the way to nevada for a while to fight what the company was doing
