Theoretical question relating Kazaa and DMCA

If suppose Shaaman Networks decided to encrypt the stuff within Kazaa... The music industry would have to decrypt in order to figure the details out (to sue innocent people, I mean). Then can Shaaman Networks sue RIAA for the violation of the DMCA?

I was sleeping yesterday night when I thought about this. Would be interesting, wouldn't it!!!
 
Actually, I dont use any p2p except bit torrent now. But it would be interesting (and incredibly funny) if Shaaaman Networks did that.
