ADRIAN, MI (WTOL) - A blatant act of civil disobedience is planned on New Year's Eve in Michigan. Bars and restaurants are being urged to ignore the state's ban on smoking in public places and allow customers to light up.

This protest is being organized by a Bloomfield Hills group called Protect Privacy Rights in Michigan.

They believe you should run your business the way you see fit without government intrusion.

The group claims 350 bars and restaurants have already agreed to break the law.

Since Michigan's smoking ban went into effect May 1, business at Club 109 in Adrian, MI has taken a hit.

"We don't sell as much as we used to. Our food slowed down, liquor slowed down during the day. Most of it just stopped," Marcie Emerson of Club 109 said.

Smokers complain they have to go outside for a butt. They support the New Year's Eve protest.

"I've smoked forever. I know it's not politically correct. I think everybody should go ahead and smoke," said one.

"When you drink, smoking and drinking go hand in hand. A combination. I think they should go ahead and do it," another added.

So what's going to happen at Club 109 on New Year's Eve?

"I think the people have to stand up for their rights. And if they want to smoke in public facilities, they have to do what they have to do," Emerson said.

At J. R.'s Hometown Pub and Grill non-smoking has always been good for business.

"I think it's something people have wanted for a long time. I think they felt they deserved it and the non-smokers wanted it and I think it's good for the community," Jennifer Steele said.

And customers here believe the New Year's Eve protest is bad for the community.

"I would disagree with it. I appreciate the fact there's no smoking in public bars and restaurants," said one woman.

"Being a former smoker, I'm more sensitive to the smoke issue," a man said.

Michigan health officials say they do not plan to monitor the protest but will investigate complaints.

Bars violating the smoking ban risk a $100 fine for the first offense and $500 for subsequent violations.

Personally, I'd say that smokers should be made to exit the building and maintain a specific distance until finished, as a courtesy to those who don't want to inhale their crap. My major complaint when I was in Vegas last year was the pervading stench of cigarette smoke. Its inescapable.

Second hand smoke is not addictive, and show me actual proof it is a serious health risk. Hell, even a minor health risk from say a few hours at a night club. I think the person next to you using their cell phone is a greater health risk than smoking. Only difference is, cell phones are not uncomfortable to be around.

I think smoking is a disgusting dangerous habit that needs to disappear forever, right after drinking.
BUT, I dont think its big brothers place to tell us we cant or where we have to.
In the grand scheme of things thats much worse than an unhealthy habit. People dont live past a hundred, and even less if they smoke. But a government oppressing its people is a process that slowly builds over centuries and takes even longer to fight back.

I applaud anyone who fights an unjust law. Private businesses should have to right to set their own policies.

Second hand smoke may not be addictive, but its just as bad for your health as smoking. Even 3rd hand smoke, being around cloth, walls, furniture, etc, that have soaked up the toxins is detrimental to your health.

Cell phones are annoying, not dangerous. :p If you're going to talk loudly on your phone, go outside or away from the group. Courtesy, people, courtesy.

Remove the smoking ban, but then allow for quick easy civil trials for those smoking near non smokers for damaging clothes and their health!

Not really. It's seriously fucking annoying how people who think like you think the world needs to bend to their will so you use the government to do such. If a business owner doesn't mind if customers smoke, then non smoking customers can stuff it or go somewhere else. If the business starts losing business the owner himself will enforce the rule. Why do you need to legislate it? 2nd hand smoke is mostly bullshit and the 3rd hand smoke crap that just came out is so laughable anyone referencing it like the guy ^ should be ignored because they are obviously the village idiot.

Well that obviously didn't happen and there was enough support out there for these bills to pass. How many businesses were actually non-smoking before? Very few restaurants were which made it damn annoying. Want to smoke?, fine with me but don't do it next to me. I'm not doing anything to directly harm the individuals around me why the fuck should you be so arrogant to screw with everyone else's health in your general vicinity?

Not paranoid, I'm a respiratory therapist and see it EVERY FUCKING DAY but no you know better so wow.

How dense are you people to think that there is some sort of time frame for exposure = cancer? ANY exposure is a risk to you, your kids, your dog. People who get cancers from exposure to second hand smoke will tell you how insidious the process is and some we recount only very minimal exposure in their lifetime to second hand smoke. The facts are, there are many people who have died or will die soon whose only crime is that they hung out in restaurants and bars where people smoked. You can chose to believe it or not, I hope you dodge the bullet you think is only reserved for smokers.

i agree, i think it's gross and would avoid such an establishment that allows it, but i support their right to do so.
