Its relevant because the law views "new" far differently than you do.

Its fine if you dont want to buy an opened game but arguing it isnt new is a losing proposition.

Well that's one law I don't need to follow. If I buy a sealed game and open it, then try to sell it on craigslist or eBay, I can ask $59.99 or $55 but it's highly unlikely I'll get a buyer.

We have already been over this. You are not forced to buy the 'open' copy. In fact, in most cases, if they catch you picking it up, they will say to just leave it. They have to have display copies and it cuts significantly down on loss if they don't contain disks, as those don't have any security on them and can easily be stolen.

The only time you have to buy those shelf copies are when they are literally the only copies available, and you don't have to buy them!

I swear, this forum is thousands of posts of the same arguments over and over. Ever week, we get the same tired ol' garbage recycled arguments. Next, we're going to hear about how the Xbox Kinect is spying for the NSA and how Forza is forcing you to put quarters into your Xbox One to continue playing...

if it's not sealed from the factory, it's not new. it's pretty clear cut and dry. i'm sorry that you are having troubles with this basic concept.

They will sell you the display one, however, you can request one that isn't opened. If it is available, they will sell you that instead. Otherwise, they have to open a new one for display.

You're crossing terms. Factory sealed != new. It is very possible to have a new game which is not sealed.

A thought exercise: the assembly line puts a disc in a case and then shrink wraps it. Is it used prior to the shrink wrapping? Of course not.

Fun fact: there is one item on this planet which is never considered to be used. Can anyone name it?

And for the car analogy, it has to be untitled or only titled to a dealership and must be under the the allotted number of miles (200 IIRC) before not being considered new.

Opened games could be argued as "demo" models, but used wouldn't apply, as most items are considered used after the store has sold them (unless they are consumable in some way, ofc).
