As a designer and a developer I see no reason why design should not be as highly protected as Software, Engineering.

Why not, I don't see why it should be illegal to copying engineering but not art or design.
So should I be able to "own" a picture of a sunset for example? Having rights to generic shit is lame, IMO anyone should have to create and design very specific stuff not general shit.
If its your own picture of a susent, sure. If you are copying someone elses work, passing it off as your own for profit then no.
You might not like it, but Apple has to do something against the manufacturers who are being lazy and not prepared to put the time, cost and effort in coming up with their own designs.

Seriously, are you mad because the keys are black? Grow up man.
They are different sizes, have a different keyboard layout (look at the arrow keys), different trackpads, the mac has a styling (or headphone/mic port) detail along the front edge which is not matched on the 'copy'.
You can't have a patent, trademark, or anything else on 'white with black buttons'.
