"My mom sold her house, sold her car, borrowed a lot of money for a lawyer to represent me," Banks said. "From Day 1, my attorney wanted me to plea to a deal. We kept denying the deals. I've always stood to my innocence.

"I guess that's just how the system works. They want to entice you with a deal to avoid any type of trial situation."

Banks had already spent a year in a jail cell fighting the case when he was told by his lawyer on the day of jury selection to accept a deal or go to trial and face 41 years to life in prison.

"She told me if I go out there and select this jury, the jury would see me as a big, black teenager and I'd be guilty," he told Leno. "I had asked to speak with my mom, my dad, and I was denied that right. I had 10 minutes to make that decision."

He was paroled and had to register as a sex offender, meaning he had to wear a tracking device and remain in Los Angeles County.

"It was humiliating, having this thing around my ankle," Banks said.

But then the accuser contacted him on Facebook, sending him a friend request.

"I didn't believe it was her -- I thought it was a sick joke," Banks said.

She wanted to "let bygones be bygones" and meet with Banks, he said. He contacted a family relative, a private investigator, to set up a meeting.

When Banks had his proof, an audio recording of the accuser admitting to the false accusation, he immediately contacted an attorney.

And, while I think the word Hate is a very strong word, I would Hate her for the rest of her natural life. We're not talking 'getting back at her/revenge' sort of hate, but more along the lines of 'even if she was lying in a pool of her own blood and needed mine to live, I would step over her and leave her to die' kind of hate.

Legal experts noted it could be difficult for the Long Beach school district and its insurer to get the settlement back.

Then there is the reality of Gibson’s life.

Court records suggest she has few assets: She received public assistance for a time and her children, ages 4 and 5, still do, according to two suits brought by the county in an attempt to collect child support. Gibson, who could not be reached for comment, was ordered initially to pay a $600 a month toward their support. But in the last year, county officials said she didn’t have to pay anything, citing a lack of income and employment.

According to Banks and his private investigator, Gibson has refused to admit to prosecutors that she lied to avoid having to return the money she and her family had won in court.

She also said she feared it would affect her relationship with her children, Banks' attorney alleged in court papers.

The statute of limitations for making a false claim is four years, but experts say it could restart when a previously hidden crime is discovered. In this case, Gibson testified in 2003 during Banks’ preliminary hearing but recanted her accusation last year. “No, he did not rape me,” she told Banks and his private investigator in a recorded conversation.

“The prosecution can say that we only learned last year that the crime of perjury occurred and therefore we are still within the statute of limitations,” Loyola Law professor Stan Goldman said.

The fact that Gibson was a juvenile when she initially made her accusation poses a potential complication, as does the fact that she has since recanted her recantation, but Goldman said the large monetary settlement she received might make charging her a priority to prosecutors trying to ensure the integrity of the criminal justice system.

Police in Long Beach said there is no official investigation into Gibson’s conduct, but officers are “reviewing the matter” and “will be in consultation with the district attorney’s office following the review,” spokeswoman Lisa Massacani said.

Yea, he's going after the state since they have $$$ (which anybody would have) but not going after the woman who has no $$$.
 
So, apparently his tryout with Seattle was Thursday. Anyone know how it went?

edit: Looks like he made Seattle's mini camp next week. He's also trying out for the Chargers.

edit 2: apparently went to try out for Chargers and did NOT receive a mini camp invite.

only because she was stupid enough to get caught in the lie, this is how it works. the cost of this crime is so low, why wouldn't a few f***ed up people take advantage?

course listening to womens rights groups, women never lie..
 
what's really fucked up is that they could send him off to prison for a crime he didn't commit and they can't send her to prison for a crime she did commit...

every single lawyer, cop and judge that has anything to do with this case should be fired for incompetence.

Has Brian Banks caught on with a team yet? The latest news I saw, that he did not have a contract with anyone yet, was at least 2 weeks old.

Really hope he gets signed on for atleast someones practice squad, those guys can make good money (relatively speaking).
