Ethically you should do your best to return it. However, that doesn't mean you can't call them, tell them you have it and then offer to give them say $100 so they don't have to pay to ship it back, restock it, and then resell it. Of course, you could mention that the box was damaged when you opened it up and isn't fit to use as a return box so they'll have to send you a new one of those too.

If they're reasonable they'll take your offer.

If it were me, i would return it, but thats only because of this experience:

In 2003, I ordered a Sony Ericsson phone from ATT/Cingular online. They charged me for one, and sent me two seperate shipments. I was like COOL, sold one on eBay, and never thought again about it. They never charged me for the second one.

UNTIL I got a letter from a collections agency in 2007 saying I owe ATT $211.99. WTF I thought to myself at the time, and after further research, realized it was for that god damned phone that I had got for "free" at the time.

Luckily it didnt hit my credit report as an unpaid debt coz that mistake could have cost me serious FICO points.

Long story short, let Dell know and return it.

How does this suck? he ordered a phone, he got one more than he ordered. Instead of looking into what his responsibility was, as the OP did here, he just said 'heheheheh I'll sell it on ebay sweet.' You can debate the ethics of that, I tend to think it is wrong, but you are an idiot to not see it is questionable and not at least look into it. Upon looking into it you'd realize hey, they can charge me for this.

I am fully aware that what I did was wrong too. I wasnt saying I didnt deserve it. I clearly stated I was "lucky" it didnt hit my credit report. Mistake made, lesson learned. .
