A Texas woman is suing Continental Airlines and three other carriers over mental trauma she says was caused by a turbulent flight, the Houston Chronicle reported.
Colleen O'Neal alleges that the October 2009 flight from College Station, Texas, to Houston -- a usually short flight that ended up taking more than two hours -- encountered extreme turbulence that caused her to fear for her life.
O'Neal experienced post-traumatic stress disorder and now fears flying, which has had a detrimental impact on her career, according to the suit filed Tuesday in Harris County district court.
Also named in the suit are regional carrier Pinnacle Airlines, which operated the flight; Pinnacle's owner, Colgan Air; and United Airlines, which recently merged with Continental

Our justice system is broken. Obviously frivolous lawsuits should be thrown out before they even come before a judge. She is banking on the airline throwing money at her to go away, and they probably will because it will be cheaper than putting a team of lawyers on the case.
 
Should be counter sued for being a moron. Can I sue the department of transportation for the mental trauma of traffic jams? Because that shit drives me up the wall.
 
The wonderful thing about our justcie system is that it is open. Anyone can FILE any lawsuit they want (though they do have to pay a filing fee). Doesn't mean it won't be immediately dismissed, or decisioned against the plaintiff, and defendent's legal expenses recouped.

This story doesn't say what her legal basis for the suit is. Best I can imagine is negligence for flying through a storm that they knew or should have known was dangerous, but then she has to prove her actual (monetary) damages, or she could win the verdict, but only be awarded $1. That does actually happen.

Actually, I think the plaintiff should be fined a stiff penalty, and the lawyers of such plaintiffs put on suspension for some time, before such lawsuits are thrown out.

I've driven in a car with many drivers that have made me fear for my life, and dated a few women that have also made me fear for my life.

I say file a frivolous suit and lose the plaintiff and the attorney pay all cost. The lawyer the percent they would get for a win, the plaintiff the rest...

Put lawyers on a 3 strike program.

3 Frivilous Lawsuits in a given 12 month span (or longer), they are suspended from practicing for, at minimum, one year. You get suspended a second time, it's 3 years. Third time, you are disbarred. Sure, we'll still end up with some frivilous lawsuits, but it won't prevent lawyers from taking cases that aren't frivilous, merely because it could be deemed so.

This system will just make lawyers much pickier about their lawsuits, which, in turn, should lower over-all BS-itude of the system.

Everyone can say "I am suing!" all day long, but the lawyers have to agree to take the case and move forward.

Its like riding a rollercoaster and getting sick. Than sueing the park because they offered it. I agree, some of these lawyers who are will to put their name a case like this should be embarrassed.

If Continental settles with this flake then more will follow her. I hope they fight and get this thrown out. The lawyer who took this case should be disbarred.

Ever been on a flight with an explosion on-board? I was ... and I didn't sue. It has gotten too easy to litigate in this country.
