Why did she wait almost two years to file suit? Judge should throw this out as she's obviously looking for a payday.

i'm reading it now. the lawyers don't understand the difference between ensure and insure.

i'm thinking about sending them hate mail.

you get 2 years to file suit.

judges in the US cant just throw something out sua sponte, unless the court lacks jurisdiction. why do people think judges can throw things out?

I didn't mention sua sponte, however, summary judgment is not out of the question, though again, I'd have to read the brief.

Hardly - no one was shot by the woman. And the pilots don't seem to have been placed on death row.

now that would be Texas!

This sounds like one of these stupid California transplants that came over because they wanted 10 times the house for a 10th of the cost instead. Oh and a job.

Cases reported as frivolous lawsuits frequently aren't anywhere near as frivolous as they're made out to be. I generally take stories like this with a grain of salt.

summary judgment isn't just the court tossing the case. and you're not likely to get it this early anyway as no judge has ever been reversed for denying a summary judgment.

although she basically claimed negligent infliction of emotional distress which isn't a recognized cause of action in texas. maybe a summary judgment on that could happen quickly.
