TAMPA, Fla. - A state appeals court Wednesday refused to block the removal of Terri Schiavo's feeding tube later this week, shifting the focus in the right-to-die dispute to the Legislature.



The 2nd District Court of Appeal in Lakeland turned down a request by Bob and Mary Schindler for a delay while they pursue further appeals, and for a new trial on their daughter's fate.

The tube is scheduled to be removed on Friday at 1 p.m.

The appeals court said the issues that the Schindlers raised were not new and had been dealt with by numerous courts.

"Not only has Mrs. Schiavo's case been given due process, but few, if any similar cases have ever been afforded this heightened level of process," Chief Judge Chris Altenbernd said.

Florida legislators, meanwhile, pressed ahead with bills to block Michael Schiavo from having his wife's feeding tube removed. The Senate and House were scheduled to consider competing bills Thursday, but negotiators said it would be difficult to reconcile them in time.

"We need to able to talk long and hard about this," said state Rep. Shelley Vana.

The Schindlers' attorney, Barbara Weller, said she was not surprised by the ruling. She would not say if it would be appealed to the Florida Supreme Court (news - web sites).

George Felos, Michael Schiavo's lawyer, did not immediately return calls.

Schiavo, 41, suffered severe brain damage in 1990 when her heart stopped, and court-appointed doctors say she is in a persistent vegetative state. Her husband says she told him she would not want to be kept alive artificially. Her parents dispute that, and say she could get better.

Late last month, Circuit Judge George Greer granted Michael Schiavo permission to remove the feeding tube. After that, it could take a week or two for Terri Schiavo to die.

Finally, this poor woman will be allowed to pass away like she wanted to. Just a few more hurdles to go.

I can't believe her parents are so selfish and would keep her in a brain dead coma against her wishes.

What if she didn't want to? The parents seem to think she reponds to stimuli. If she wanted to live, would you still be infavor of pulling the plug?

Also, why doesn't her husband simply divorce her instead of insisting on her death? I hear he has had a girlfriend for many years anyways. What does he have to gain by her death?

I think this is horrible. If she wants to die, can't they just give her an overdose of something? Instead they are going to starve her to death! For that reason, she should be kept alive. Nobody deserves to be tortured.

He is following his wife's wishes. She expressed to him that she would want to die.

Her parents seem to think she responds to stimuli. The key word there is think. Numerous doctors have shown that she has zero brain function at all. She has been that way for over 10 years.

He doesn't gain anything by her death. That's the point. It's not for money, it's not for anything for him personally.

She gains something by her death, because in a sense, she has already left this world.

This is just sad news no matter what side of the issue you stand on. I think she has suffered enough and instead of suffering further, I think they should end the pain. Not only has she suffered all these years, but so have her friends and family and of course, her husband.

I will take her husband's word that she has hinted in the past of not wanting to live, but that does not mean that he's not lying. I am leaning towards the position that she should be let off the life support machines and die. That sounds harsh, but I believe thats best for all sides. I could be totally wrong, of course.

But before they make the final decision, make sure that her final moments do not bear more pain upon her.

pretty sad all around. Her husband should have had the authority to make all medical desicions if she could not, isn't that one of the points of marriage? why would you marry someone if you didn't trust your life in their hands?
i would expect her husband to know better than her parents what she would want. I doubt she had conversations with her parents about what to do if i become a vegetable. who the hell would have that conversation with their parents and not their spouse?

hell yeah maybe they could televise it!

who the hell thinks i'm a compassionate leftist? but yeah i would rather her get a leathal injection, guess that makes me compassionate. but either way she won't feel much pain. if they take out her tube she will be getting plenty of morphine.

Terri never signed any directive or living will and there is no evidence that she foresaw her present situation.

None of these behaviors are simple reflexes and are, instead, voluntary and cognitive. Though Terri has limitations, she does interact purposefully with her environment.

On March 8, Congressmen Mel Martinez and David Weldon introduced H.R. 1151 and S. 539, the Incapacitated Person's Legal Protection Act. The legislation that could give Terri Schiavo, and those in similar situations, the same Constitutional protection of due process as death row inmates.

This bill was sponsored by two Republicans.

God bless these people but in they're in the wrong party.

Well, I do to, if there is reason to think she can respond as that website says she does. But I have to hope that the Judge is doing her job, and she probably can see the reality more objectively than the family.

As far as I know, the judge has never seen Terri.

You would think that he would at least visit her and see her condition for himself, wouldn't you?

holy crap under Subsection 2256 any person incapacitated and without a written directive would come under the custody of the STATE if their guardian is authorized to refuse medical treatment for said person, WTF?!
