Yup. They were negligent, in not securing their site, so that kids couldn't get in.
At least, that's how the judgements tend to go around here. Any remotely dangerous industrial site has to have huge barbed wire or electric fences, because if someone broke in and got injured, the site owner would end up getting prosecuted or sued.

That smell... that's hydrocarbons from the oil. Get just the right concentration of them in the air above the liquid and it's an explosion looking for ignition.
