You have to remember that the defendant has a right to a speedy trial. For some reason, he did not exercise this right. I don't know the details of this case, but it sounds like a fail job by the lawyer. A jury would have a much harder time throwing a 16 year old boy in jail for 30 years than a 19 year old man.

The problem with what you suggest though is that a person can pretty much "filibuster", delaying their trial with motions and so forth that by the time sentence is finally handed down, "time served" while on bail would have gotten him off with no jail time.

Was not aware of that right, then yeah his own problem for not exercising it.

But if he had not done such a stupid sicko act in the first place he would not be in that situation, so my sympathy is quite low either way. The force be with him, always.
 
First of all, I'm of the belief that people who commit forced sexual crimes are almost never "rehabilitated" and they can be separated from society for life, for all I care.

But as far as this article goes, am I missing something or do they just need a better editor?

A 19-year-old Riverside man was sentenced Friday to 30 years to life in prison for the sexual assault of a then 9-year-old boy with a toy light saber in 2008.

Perez was home a the time along with Oscar Antoneil Arreola, then 19, and two boys, one 12, the other one 8, according to Deputy District Attorney Jana Hoffman.

Was he 8 or 9? Wtf.

Why is the legal age of adulthood 18 and not 15? A reoccurring theme on these boards is you should know better by 13-16.

Most of the people I am seeing agree that 16 was old enough to know better.

I think mainly it's for vandalism stuff. A lot of teenagers vandalize stuff so if they were charged as adults it would really fuck up their lives early.

That's a myth people perpetuate to comfort themselves that a vile criminal would get his punishment even if the system was too lenient in the eyes of the public. The reality, of course, is far from this.
 
Did he confess? From what I read it was two adolescent boys who were testifying against him, unless he confessed to everything they claim he did i call shens on at least part of it. I mean having worked with 8, 9, 10 year olds etc. They will say almost anything to get out of trouble or to get someone else into trouble. Now im not saying he was innocent (far from it) but I think 30 years on the testimony of an 8 year old and a 12 year old is a bit fucking harsh.

Does that mean there was no evidence it happened or no serious physical harm? I mean if you are shoving a light saber and then apparently a hand as well i would think that would cause SOME damage...

The whole case just seems wrong to me, if he did it fine, but even if he did it i still think 30 years is 10-20 years too much.

Wasn't there some story not too long ago where a kid was claiming she had been sexually abused by the neighbor. I don't remember if the dad did anything prior to calling the police. But it later turned out not to be true.

Exactly my point, i think some people (judge and jury in this case) will believe the worst in people simply because it is a child and children are innocents who couldn't ever lie. 🙄

I would bet that what really happened while probably somewhat disturbing and probably inappropriate was not bad enough to warrant 30 years.
 
30 years for an assault that occurred when he was 16? Sorry, but that's excessive.
Unless there is other stuff going on with him I agree it sure sounds overboard, but this country goes absolutely ape-sh*t over sexual assault.

30 years from now there will be a very bitter, completely hopeless 49 let out on the world.

Seems about right.

I also think the OP should get some time for a carefully chosen, highly misleading thread title.
