If they'd used an uncased black iPhone5 for that pic, the resemblance would be uncanny.

Well F me, it's a rectangle with rounded corners! RIM is so late to the game that they really needed to go with an irregular polygon of some sort in order to stay out of court.

As an early player, BB surely has a pile of crucial patents for self-defense.

In fact, at some point that may be the only thing valuable left in the company.

RIM certainly does have a large collection of patents in their wallet, but do they have the cash to sustain an extended legal battle?

I don't think Apple is going to waste money and time going after a dying company.

Rim, unlike Android, has been making rectangles with rounded corners, and home screens that are a grid of icons, since long before there was an iPhone.

Not saying Apple won't sue, but it's likely not to go far. My best guess is Apple won't bother suing until/unless BB10 starts taking significant marketshare.

That looks more like a Motorola Droid X than an iPhone to me.

Honestly though, it is a rectangle. Phones have been rectangles for a while, and there are only so many ways to do it.

It says blackberry on it. Or would people think that someone put a blackberry emblem on an iPhone?

Apparently that kind of logical, common sense thinking doesn't work in the real world where Galaxy Tabs get sued despite clear Samsung labeling. ;)

The "Blackberry" front and center and the defined breaks from the screen to the case at the top and bottom are pretty distinct imo. Otherwise, yes, they both are roughly the same size/shape and have glass on the front.
