Daniel Schuler, whose wife, Diane Schuler, killed herself and seven others in a wrong-way crash on the Taconic State Parkway is suing the state and his brother-in-law, whose three daughters were victims.

Daniel Schuler filed a lawsuit Monday against the state in the New York Court of Claims, arguing that the highway was poorly designed and lacked proper signs.

Toxicology reports determined that Diane Schuler was drunk and high when she crashed her minivan into an SUV occupied by three men, but her husband has contested such accounts.

Daniel Schuler also filed a separate suit last week in state Supreme Court against Warren Hance, whose daughters Emma, 8, Alyson, 7, and Kate, 5, were killed, the New York Post reported today. He argues that because Hance owned the minivan that Diane was driving, he is “vicariously liable.”

Schuler’s attorney, Kevin Grennan, did not immediately respond to requests for comment today.

Diane Schuler, her 2-year-old daughter, Erin, and her three nieces died in the July 26, 2009, crash, as did the three occupants of the SUV: Michael Bastardi Sr., Guy Bastardi and Daniel Longo of Yonkers.

I was just going to post this.

I just watched the video and this guy is a piece of work. He's suing the victims family PLUS the State of NY ... for a badly designed highway? All this is mind-boggling considering that HIS wife caused the accident and had the equivalent of 10 drinks in her!

There is one person more insidious than this guy ... the lawyer representing him.

and not to be anti-lawyer, but this is one of those cases that illustrates, to me, that there simply are far too many lawyers around. The willingness to take up such a suit seems to reflect there being far too many lawyers for far too little quality cases.

If you aren't turning people down like this, then there just isn't enough work to go around.

Further, it seems that in the urge for schools to pump out generation after generation of lawyers, they appear to have jettisoned the ethics part of their education. I know that scummy people are scummy people....but it does appear to be getting worse. Maybe we just hear about it more. I don't know...

Unfortunately, the case was likely taken on a contingency basis, meaning the plaintiff pays nothing to the lawyer unless he wins, and then the lawyer gets somewhere in the range of 20% - 30% of the judgment.

This is pure BS. The legal system does not demand a lawyer take on a civil lawsuit. It only demands that a person is entitled to legal representation in a criminal suit ... and even this does not mean a lawyer can't walk away from a case if he finds it reprehensible and is therefore unable to provide an adequate defence.

There is no law that demands lawyers take the case for lawsuits. In a Court of Law, a defendant has the Constitutional right to be represented.

The story up here in the NY area is that this guy is pennyless after the estate got sued by the victums in the other vehicle. So the lawyer has to be taking the case on contingency. This asshole has nothing to loose because our fucked up system will let him try to get whatever he can.

This just means that if you truly are screwed then your lack of deep pockets makes you even less likely to win on your own; this leads to only class-action suits, which in turn means that the injured parties get very little but the lawyers make big bucks.

Wow.. so instead of lawyers winning republicans make it so both businesses AND lawyers win.

Unfucking believable: I love you democracy.

Wrong. The legal system requires every CRIMINAL defendant to have a lawyer. It does not require attorneys to take every BS civil case that comes their way.

Though I agree that this lawsuit is in bad taste and probably baseless, one should never take the allegations stated in a civil complaint literally.

That being said, is there any reason to believe that the highway was poorly designed or lacked proper signs? Though she was drunk/high, is it possible that the design of the highway could have contributed to the accident? I am not familiar with the area.
