Taking a roomate to court....

Anyone ever had to take a roomate to court over owed money?

Current roomate is refusing to pay rent for her last month of living there (she is still in the premise). We have a signed contract that she filled out saying she WOULD pay her rent, all the dollar amounts included, etc and WOULD move out at the end of the month. We already have a new roomate signed, contract, deposit for when she leaves.

I have access to free lawyer services should I need them, but wouldn't something like this be small claims court? (Under $500)

Anyone have any advice/input? OH I HATE ROOMATES!

Take the contract and file a small cliams action. You don't need a lawyer for this.

If she isn't paying rent already then she is voiding the contract and therefore no longer lives there. Change the locks and tell her you'll let her in for her stuff for the amount of the rent she owes.

Based on what you said it sounds like a clear cut case of her being wrong. Use your free services. If they are not covered go to small claims court and file the small fee. It should be easy enough to win this one. You show contract and bring in a witness perhaps. Then it's up to her to prove that she paid the rent, and she can't. So judgement fuond for plaintiff!

At least that's how it goes on tv.

I'm taking my exgf to small claims court. I gave her $3700 for a downpayment on a house and made an agreement about payments, etc. I broke up with her shortly there after and she hasn't paid me a cent in 8 months. Last month, I sent her a certified mail request for payment by Oct. 1, otherwise I was going to take her to court.

She'll pay dammit!
