I think this needs to be in that Dumb Ways To Die video.

"Punch a gun who's holding a gun..."

Meh, I can't make it rhyme.

They started the confrontation, he didn't back down or retreat... they turned it violent... he shot. This is a mess.

The question is, can he respond to assault with deadly force? If Zimmerman is in trouble while being seriously hammered while pinned on the ground - this poor clerk doesn't stand a chance in hell.

He will be guilty of at least manslaughter. I... think it may be the right call, but there's some room for argument.

The puncher for assault for sure. The clerk shouldn't go to jail, but opening the door at 3:30 was a dumbass move.

Zimmerman hasn't been convicted of anything and he doesn't have a video showing him being assaulted.

Punch thrower should be charged and sent a bill for 1 (one) cartridge, and the employees losses regarding his employment if any.

The clerk is not going to face charges over this.

Watch the video here: http://www.khou.com/news/local/HPD-...ied-to-enter-store-after-hours-180852791.html

The attacker was belligerent, wouldn't leave the property when told to, and had two armed friends in his car. Those armed friends actually fired back after the clerk shot the attacker.

The clerk had every reason to fear for his life when that punch was thrown, and did the right thing by defending himself. It's too bad he didn't fire his weapon until empty. My guess is if the attacker recovers, we'll be seeing a civil suit filed against the station owner/clerk.

Why does noone ever get shot in the knee for acting tough like in the movies? Every action film I saw as a child, the asshole gets shot in the foot first..and then the knee. The shooter leaves them writhing in pain as he flicks his cigarette..

Instead of insurance paying out $300,000 to the family of the deceased.... the guy with a bullet in the foot and the knee would get $30,000,000 for pain and suffering.

If someone has better info than this let me know but my assumption about why he opened the place at 3:30am is that it was in fact 24 hours, and that the employee had gone on break.

I think these guys probably arrived during that break and got pissy the doors were locked, and instead of politely, patiently waiting for them to be reopened decided to yell and scream and intimidate. Should the guy have kept them locked at that point? Maybe. But if the store is meant to be open for business again, and his break's over, I can understand why he'd just sort of be like "okay motherfucker, come on in, get what you want and get the fuck out" hence his hand motion for the guy to come on in.

But the guy couldn't just leave it be and had to keep up his shit, and then throw a punch.

I'm glad he got shot and I wish he would die.

No room in civilized society for his type, and they are all too common and getting moreso. At some point I think a decision will have to be made, keep a civilized society, or keep people like this around. I know what my vote is. (And no, this has nothing to do with the guy's race)

Well thats good ain't it, sticking it to the wealthy people.

The clerk is not wealthy and from the looks of the Convenience store owner he is not wealthy either.

That is ridiculous. That punch didn't do any damage, look the clerk shrugged it off.

He should've let the thug and his friends beat him up until 1 punch before death before shooting is justified.

The sentiment in this topic has caught me off guard. Never expected a single punch to be grounds for deadly force in the eyes of P&N.

The crumponite crew is still sleeping off their hangovers.

They have made very clear that a single punch with no noticeable damage does NOT justify lethal force. You must wait until you are literally in the middle of dying (IE bleeding out etc) before shooting someone who is attacking you.

The guy who threw the punch fucked up really bad. Although, it may be a little much to shoot a guy that just punched you. However, being that both of his friends were armed may change things.

Regardless, the guy who threw the punch assaulted and battered the clerk who has every right to defend his person.
However, the store clerk should have never opened the door in the first place. He should have called the cops and let them deal with it.

The guy who threw the punch is at most fault here. But why did he open the door and did the dude hit him because he had the gun out? But the dude who threw the punch is at fault here.
