Im not too worried. The more and more the SCOTUS proves they have abandoned the tenants the founding fathers checks and balances were supposed to prevent the quicker they will de- legitimize the court. Pitchforks and torches will be making a YUGE comeback very soon...

Kennedy is a conserative but tends to vote down the middle, taking neither side. If he leaves Trump will probably gkive the job to an extreme conserative who will vote to overturn roe vs wade and gay rights. What a sad day if that happens. Decades of advancement could be wiped out.

Kennedy retirement rumors have been going on for like 2 years off and on. If he does retire doubt it will be immediate.

Politically could be giving the Dems a window to take back the senate and force Trump to nominate someone with at least his social sensibilities. Really doubt he’s eager to watch Roberts overturn his legacy as quickly as cases allow.
 
Which really doesn't explain the way the GOP treated Merrick Garland at all.

It makes perfect sense if you understand how the right and by extension the GOP operate. When they aren't in power everything is an option, no shady move is too shady if it means a win. But...if they are in power then every one of their moves is noble and there is no need to pay attention, everything they are doing is perfectly reasonable.

The rumors have been around for awhile but the chances that he or RBG hold out until 2020 are slim. Breyer is up there too. I think I made a thread about this subject recently. If all 3 of them go before 2020 and the blue wave fizzles out I am going to laugh and laugh at all the liberals and independents that thought they had the luxury of being picky about the Democrats' nominee.

I think Kennedy is the only justice giving a patina of legitimacy to the right wing majority, while at the same time still shilling for the GOP on the most important issues. It may be better if he leaves.
Gay marriage was settled by the American people, not SCOTUS.

If the Democrats retake the senate they should refuse to seat any justice. I’m not joking.

If they take the Senate then they can just vote down anybody Trump sends them, one after the other. Mitch couldn't do it that way because he couldn't hold his members in line.
 
Thought y’all were the high road party. And set on governance. And all that.

Doesn’t matter; whatever Dems do the Republicans will adopt the measure and will make the impact harder by an order of magnitude. Each time this happens with a limited Dem tactic like filibusters or slowing down nominations the GOP invokes the nuclear option of the same at the next opportunity.
 
Exactly, but that only works if both parties are committed to it. Classic game theory, in competitive games with an incentive for cooperation you have to retaliate when the other party defects in order to get your counterparty to behave. I’m sure you agree?

What’s the answer, how do we break the partisan gridlock

Kick out the deplorables and enact laws that protect norms and institutions.

The fixes themselves are easy. The hard part is gaining the power to enact such fixes. It's why, when the Republicans gained power, their legislative agenda wasn't to address issues Americans are concerned with but to protect their power.
