Sucky Dilemma : Ebay problem

So, me and friend pool some money together to buy a few SSDs off ebay.
After I pay the scam artist, they drop off the face of the Earth and I have to open a claims against them in order to have them ship out.

So, while I?m away from the weekend the package shows up.
They drop kick it to me through USPS in a crappy package and charged me 40$ to ship it when it only cost them 7$.

So here?s the problem.
Do I open the package (which I probably won?t do) or drop kick it back to them?

It probably is the drives, but they could foobared, since they broke faith already why should open them?

Anyone have any good suggestions?

Right now I am going to send it back to them and hand over shipping documentation to Amex.

FYI : Paypal told me to open the package, what they failed to mention until I got into an argument with the CSR was, once you OPEN a CHARGEBACK through your credit card, it isn't their problem anymore.
