Stupida$$ roof is leaking bigtime - called the landlord to fix it - now he wants us evicted

Ongoing problems with the landlord. Yes, I owe him back rent, but have been dutifully paying on it when I can. Current rent is constantly up to date.

So last week, the roof back room starts leaking through .... AGAIN .... and this is after they came and did a crap ass job putting a tin roof on during the summer because it leaked LAST winter too. So we gave the landlord a call last thursday. Yesterday, we get paperwork requesting we vacate the residence or face eviction. WINNAR!!!

Needless to say, we've already been to court once, and if we go again, the judge will laugh right in the landlord's face and tell him to suck it because our current rent is up to date and we're paying on the past balance (the judge basically said that last time in court).

Man I can't wait to get out of this hellhole.

I don't care about winning. I just want to get out of this place. The guy is known in this town basically as a "slum" landlord. Too bad I found this out only after I lived here a few months. From now on I'm asking the prospective landlord for references.

And Ameesh - it's either going to be VA or WA (I hope). :)

In some states he can give you a thirty day written notice to vacate without cause. Do you have a lease, or are you month to month?

He gave me a 3 day written notice, in fact the very same one he served us with in January when we went to court. I'm certain that he did it just to try to get us to give him some money (which we don't have at the moment). Even so, the judge said he would not grant eviction if we were paying current rent.

And no, we're not on a lease anymore, though I'm told that HUD holds a lease for us right now. Dunno though.

Make the leak bigger if he won't fix it. Then you can get county building inspectors on the lanlords aszz that he has to fix it etc...and, I'm sure you've gone to court with him for wrongful eviction; he can't evict you just because he doesn't want to fix the leak.

Good luck on the situation and keep us updated. Oh, and do not use an umbrealla indoors (bad luck, but if its leaking this bad, get yourself outta there!)

How much do you owe him? Did you contact him when you knew you wouldn't be able to pay him the rent that you agreed to pay, an tell him you were going to be late? How many months did you live there without paying before he took you to court? How much are you paying on the past balance per month? Are you paying him interest on the past due money you owe him? It sucks that his roof is leaking, I am sure he is not happy that he has to do repairs. It might even be financially hard for him to pay someone to do it. He might be a little short this month.
"Hello, Ace Roofing, I need a roof fixed on an apartment. Oh, and after your done, I am going to tell you that I will pay balance when I can. "

My roof leaked last week on my personal items. I called the landlord and inquired who was coming to fix it, 'cause he said he had a guy coming that week ... he said "you're starting to piss me off, dude" ... and I unleashed the fury that is my anger on his ass ...

next day someone was out there putting a new roof on.

You have to flex when they step to your sh!t.

Then again ... you are constantly late in payment ...

heh. i lived in a apartment where the roof leaked. it leaked on my computer and TV. I called the landlord to fix it he said they would be there in a few days. I argued with them but it didnt help. So i called the city inspector who called them. I had the roof fixed the next day.

I ended up moveing at the end of the year. I just needed a place to live until i found a house to buy heh. I will NEVER live in an apartment again.

our roof is leaking and so is our toilet, but our landlord is really cool about it and comes over fixes crap for us. sucks to be you.

The landlord is a CPA, and it's tax season, and not to mention he owns many properties in this town as well as surrounding towns. When HUD said "fix this list or you get no money", it got fixed.

Actually, no. I am current on payment, as I said previously, and, as agreed with the landlord previously am making payments on the previous balance.

There are several more repair/upgrade issues also, stuff that has been promised to be repaired from when we moved in here, that still aren't. I have a couple plywood boards covering holes in the porch for example. As a note - when we moved in here the previous tennant left TRASH (as in garbage, refuse) all over. Prior to acquiring possession of the place, they cleaned up all the trash... but simply bagged it and threw it in the basement where it festered for about 5 months. After numerous phone calls it finally took a visit for City Ordinance to get them to remove crap.

imagine if you were on the other end of this deal. it doesn't matter what your landlord does, he depends on the money he is making off you, why should he get screwed for no reason?

In other words, you have 2 computers, Oingoboingo and The Wife's Beast, which you won't sell to pay the back rent in full and you are shelling out money for that Verizon DSL each month which you won't stop using.

You also seem to have a computer gaming budget which you don't plan on curtailing. Edit: Wrong crab

Plus you waste time posting about about being bored instead of doing anything constructive like working a couple extra part time jobs.

I can see why your landlord loves you.

You don't quite understand here... he IS getting his money, including back rent. I am not trying to screw him over, as much as I'd like to for his assenine antics. I pay the rent monthly, and it's subsidized as well so he gets a gov't check every month too. The guy is just a stingy tard that only cares about money. I would understand from his position if he wasn't getting anything out of me, but the terms are more than amicable at the moment. He is NOT living up to his responisibility as a landlord, and just being a jerk about it in the process.

As I said before, in case the nay-sayers weren't reading correctly - a judge has already said that they would not grant eviction because we (the tennants) are doing everything in our power to keep our end of the agreement.

Actually, I haven't updated my profile in a while and only have 1 computer at the moment. I no longer have DSL. My gaming budget consists of acquisitions from FS/FT here and/or over on Ars in which I trade for. I waste time posing about being bored when not scheduled to work - let alone finding extra part time jobs in a market that's completely saturated (anything remotely considerable, including Burger King for that matter is highly contested up here because retail and service industries are the only viable jobs up here).

Fix it/clean it myself? Let's see. I've already repainted the bulk of the house interior, not to mention patched several large pre-exisiting holes in the walls. I am refinishing the kitchen on my own accord as the cabinetry is dilapidated and falling apart. I removed decaying carpetry in the back room which is currently leaking (I wonder why it was decaying) and replaced it with linoleum tile AT MY OWN EXPENSE. I have removed several young trees that threatened the foundation of the house (ie: growing directly from between the soil and foundation. I have repaired portions of the sidewalk at my own cost. I have replace and/or fixed several fixtures within the house, including the upstairs toilet and sink, and am refinishing the walls in the upstairs bathroom. I have cleaned out a portion of the said trash in the basement prior to it's removal - at my own cost and the cost of a dumpster. I have removed a delapidated and potentially dangerous rusting children's swing set (which had broken parts and sharp edges) from the back yard.

All of these things were done with the landlord's approval by the way.

And then you have the gaul to tell me that I should be the one to repair a leaking roof when it should have been repaired properly the first time it was done?

Nice try.

Edit: Oh, I forgot to mention - the unit also included a Washer and Drier, both of which I've repaired once each already.
