Student sues, left off volleyball team

DENVER (AP) -- A female senior at Grand Junction High School who can't play volleyball because she didn't make the varsity team filed a lawsuit Monday alleging the school treats girls differently than boys.

Unlike boys who play football, girls don't have the option of playing on the junior varsity volleyball team if they fail to make the varsity team, according to the lawsuit filed in U.S. District Court.

Jessica Wieker's lawsuit alleges Mesa County Valley School District No. 51 discriminates against girls, which is a violation of a federal law known as Title IX that guarantees equal gender access to public education.

An after-hours phone message left at an answering service for the district was not immediately returned. Wieker's attorney, Michael Grattan III, also did not return an after-hours phone message.

Wieker also alleges the school treats girls differently by not offering as many opportunities for sports for girls and provided buses with onboard bathrooms for the football team, while the girls' volleyball team travels to games on district-owned vans driven by coaches.

ha ha, there are other ways to meet other lesbos.. i kid i kid...

i tried for varsity baseball but wasn't good enough and JV wasn't an option because i was a senior and JV was for first and second years only.

i've never seen a senior play in junior varsity. at my old HS, junior varsity included students in the 7th-9th grades.

the story doesn't mention if she talked with school officials about it before the suit was filed. i hope she did. if she didn't, then the suit is pointless. if she did, then the suit is not pointless.

GJ HS only has 614 students. It would see that there are probably not enough for a JV squad. She is also a senior and too old to play on the JV squad, whether GJHS has one or not...



my high school didn't even have 300 students but we had a varsity, jv, and freshman vollyball squat. They're a pretty good team too, won conference every year I was in high school and state a couple times.


*age wise, I don't think any seniors can play on jv in those smaller schools. They don't in football either. I guess it depends on the state though

At my HS if you were a senior and you didnt make varsity, you were done. There was no JV for seniors.

I love her arguement about the football team on buses vs the volleyball team in vans. Did she forget that a football team has like 70 players while a volletball team has like 12?

a relative of mine was one of the titleIX plaintiffs, and her family helped finance the suit all the way to the supreme court when brown university dropped her volleyball team.

Do they not have a JV Team or are seniors just not allowed to play on it? That's retarded. I went out for Soccer for the first time my senior year (hadn't played in years) and played JV. Never heard of not allwoing senioes on the JV team before.

Did she also forget that the football program brings money into the school and the volleyball program just eats money?

I ran cross country in high school and I was always thankful for the football team. If it weren't for them then none of the non-revenue sports could even exist.

I think the point was the bathroom on board... but the school can easily win that point using your logic. The buses happen to have bathrooms.

Otherwise, her suit may have merit.

That's much more than what my HS had in my time, approixmately 75 students total and JR V is for those who doesn't have the skills regardless of AGE.

I might be reading this wrong, but isn't her point that Male seniors who don't make varsity football allowed to play JV, but girl seniors who don't make varsity volleyball can't play JV. but then again, I might be wrong cause the quote above doesn't mention if it's senior boys who don't make varsity. however if it is the case were senior guys who don't make varsity football can play JV but senior girls who don't make varsity volleyball can't play JV then I think she's got a legit beef, and the whole bus thing is b/s.

actually, I'm assuming that there is a JV volleyball team, if there isn't a JV volleyball team then I'd say SOL and no lawsuit will help because if the school only has budget for a varsity volleyball team and no jv team then that's just how it is...

and if you suck at volleyball don't expect to make the team.

there are some legitimate injustices in the world, but sometimes there are just big crybabies who got their own way their whole life feeling hurt when the real world finally hits them in the face. sometimes the real world isn't 100% fair.
