How come AMD can use SSE, and SSE2 in their processor for addiontional instructions sets but INtel don't support 3dnow?

Because SSE was first and AMD pays royalties to include support for the instructions in their processors. AMD will start incorporating SSE2 with the upcoming ClawHammer (AMD Athlon 64? I think that was the public title). In theory, Intel could license 3D Now!, but it had very little developer support and was similar to SSE to begin with.
