Thats actually a myth, at least in IL it is. I've talked to a few cops here and they say that they don't have to show squat. And I've never heard of anyone getting off because the cop didn't show them the radar gun.

File a motion for discovery of the radar/laser's printout and all of the officer's notes... if you think he made it up, you'll find out really quickly... if at the day of the trial they still havent handed over the stuff, tell them you havent waived your right to a due trial, that even if you got it all now, you couldn't prepare a case in the next 30 minutes and the charges should be dismissed

alternativley, you'll get a copy of the printout and be pwn3d

ok here's a transcript of what I will say to the judge if the cop shows up:

"Your honor, I would first like to state that I have had no prior convictions of this nature and have been driving safely for years with nothing on my record.

This officers claim that I was speeding 23 over is just impossible. I had my cruise control on 45 as I always do in 40 mph speed limits such as these.

I would like to also note that as the officer marked on the ticket, the road was light of traffic and I recall a few cars that passed me that were going over the speed limit, much faster than I, and I very much believe that the officers clocked one of these vehicles and not my own.

Finally, I would like to ask if the officer has documention showing how recent his radar was calibrated to ensure that it was functioning properly at the time of this event.

And does the officer have documentation of the accused 63 mph speed at the time?

That is all your honor..."

meh? eh? any corrections? or HELPFUL hints and not criticisms, because thats all I've seen on this thread thus far.

I was able to do exactly this yesterday. 21 mph over, paid $250 extra and got 0 points.

You are wrong. The officer that pulled you over does not have to show up. It simply has to be an officer from the precinct (or town?) that you performed the violation in. I know this because when I fought my ticket, the cop that pulled me over didn't show, and I still went through the regular procedure.

The Judge will laugh at you, and call you a pretentious prick while he makes you pay dearly out of the ass.

And the judge can fine you for 45 in a 40 as that will be a confession of guilt. Never say how fast you were going if you can avoid it.

1. go to court. chances are: he wont show up; i've taken 2 citations to court and the cop showed up neither times. if you lose, you have to pay citation fine---big deal, you were going to have to pay it anyways

2. radar detectors are the biggest rip-offs in the world. hahhahaha. really, they are.

Well I finally got mail from the court letting me know the date of my court hearing. Which is August 19th, so I'll gladly let you know what happens.

But early prediction, the cop will show up and the judge will give me some sort of community service. + fines.

1. Plead not guilty.
2. Request trial by affidavit/written appearance.
3. Request discovery of critical/frivolous items.
4. Based on fulfillment of step 3, request dismissal or continuance.
5. Write a good argument/excuse for why you are not guilty.
6. Profit.

Take comfort in the fact that even if you don't win, you had better chances of getting your ticket dismissed than if you pleaded guilty. And as an added bonus, you can make those pigs actually work for their bullsh1t fines.

Hire a Lawyer...will be less that $500. I've had 3 tickets since January. No Points, Insurance doesn't know, all 3 speeding tickets and lawyer cost me less than $800.

Pacing, vascar, radar. The x50 would have gotten radar, vascar you would have seen yourself unless you're a 'tard, and you didnt' say if he was pacing you. This should be a NO BRAINER that he made it up if he came off the side of the road. Filing for discovery would almost surefire result in the charges being dropped.

I even re-read the OP thinking it was a new thread and searched for "discovery"

WHAT DO YOU KNOW? I told you to do it WEEKS ago :thumbsdown:

and you think you're going to get to read a transcript in court. you are about to be pwn3d :laugh:
