If you get a speeding ticket and haven't had one in over 3 years, can you request a hearing then try to get off on your "good driving record"?

Request a trial.

Chances are the cop won't show and you'll win. Don't worry about court costs, you don't have to pay for them as long as you show up. The judge will not let you get away with it just because you have a good driving record.

Here in California you can go to trafic school and your ticket won't be put on your record. You can only do it once every three years. The phone book is full of diffrent schools.

despite what other people say, I think you have a fair chance. Just hope you werent going toooooo fast. Just dress nicely and try to negotiate with the prosecutor. Goodluck, my court day is coming up in 2 weeks

I got written up for going 48 in a 30.

First off, there was NO WAY I was going 48. I've driven the road many times and it curves too much to be going that fast. I was definitely doing about 40, though.

The cop checked off both "radar" AND "estimate" on the reason for the ticket.... this making no sense to me, and I truly don't think he was radaring at all.

I think I may request a court date.

spooner is it ever possible to argue against a radar and win the case in ur favour. I have a ticket too and I doubt I was speeding, but since the cop caught me on radar I simply assumed that he must have been right. I just dont understand what people argue in their favour when they go to the judge.

Well, I'm almost certain he didn't even use his radar, but since he checked it (including the "estimated" box for some reason), I guess there's no way around a lying cop.

I've heard you can appear before a judge and just try to get off on your good driving record alone. I've seen this done before.

in CA you're allowed to have a ticket once every 18 months if you take traffic school :p

my question is:

i got in an accident that was "my fault" 3 years ago. will it affect my insurance, even after the point gets erased after 3 years??

Just call the municipal court house (assuming a local cop issued the ticket) and find out what your plea options are. If you are a good driver, request deferred judification, or ask to have the ticket dismissed in exchange for you attending a defensice driving class.

Damn, there are some uppity people here. How can someone compare MURDERING someone to speeding?

Definitely request a court date. If you have a good driving record (which it sounds like you do), they will generally make you pay the fine regardless, but they will probably remove the ticket from your driving record.

Some idiot who was speeding by my house (speed limit 25), hit me and totaled both cars I still get headaches (bad ones) because of it. All because you idiots can't drive safely. If you were doing like 48 (or even 40) in a 30mph zone, you DESERVE a ticket. You are NOT a good driver. If I were the judge, I would laugh at you and tell you that if you don't want a ticket or the points, DRIVE BETTER! Why can't people just understand that? Yesterday I saw someone swerving all over the road on a single land road trying to get around the car in front of them. I was going in the opposite direction and after I passed the 2 cars, the one behind just gunned it, ran a stop sign and we flying past the other car. That person is not murdering anyone, but should they get points points taken off if they were caught? Where should the line be drawn? In my oppinion, people who drive 10 over the speed limit are stupid and don't deserve to be on the road in the first place, let alond complaining about getting a ticket for breaking the law.

Just because you're bitter becuase some asshole hit you and you have these "headaches" all the time doesn't give you the right to call me a bad driver. I'm a fine driver. Step 9.

On my good record, I deserve to pay the fine, but don't want the points. Simple as that. I bet I get off too, just to piss you off

Sorry to hear about your accident, but speeding is not even in the same ball park with murder.

You don't have to be speeding to drive like an idiot, but the combination of both is defintely bad news.

If you were driving with traffic, did everyone else get a ticket too? or are you just rationalizing what you did? It's funny how people break the law and then try to justify it by saying how "everyone else was doing it!". I'm bitter about the fact that people routinely speed and don't care about the consequences. Then, when they get caught, they complain about how unfair it is and how they shouldn't have to get points taken off their record.
