speeding ticket advice.

I had cruise going at 79. saw the officer. pulled me over. My dad was following me so he pulled up too but did not get a ticket.

officer walks up.. license reg. do you know why I am pulling you over?

Me: well once I saw your lights and looked down I had a decent idea..

takes license, walks off.

walks back up with a ticket and says:
"I clocked you going 82 in a 70 but wrote the ticket for 5 over." and then he mumbled something about my three options and started to walk off, but it was raining so I felt like he hurried it. I responded with "well whats my best strategy here..." And he says if you had given me some sort of explanation... and then a little more mumbling as he walked off..

I am 24 and have never had a speeding ticket. I talked to the lady at the court and she said that this ticket has NO POINTS involved with it.

Is it worth it for me to go to court to try and get it off my record for insurance? Or does that happen?

you should have flashed the cop. you'll end up spending more going to court (missing work or what not) if its not too expensive then just pay it off. your insurance shouldn't spike dramatically. when you hit 25, your insurance should lower anyway.

In Kansas anything under 10 over in a 65mph zone or higher does not get reported to insurance. If it'sa under 65mph you have a 5 mile buffer.

First offense 5 over go to court and the juge will give you a slap and tell you you have a certin time frame in which if you dont do anthing to get another ticket with in said time frame it will be thrown out of court. Cant tell you how many times that has been done with me so dont sweat it. Go there tell him you were sorry and had the cruise on and cant believe I got got a ticket for 5 over. He wont do a anything but give you court supervision. Wont cost you anything but your time. Just make sure you pled guilty but ask to tell him you had the cruise set and your dad was following you and didn get a ticket.

He was going 12 over, the ticket was written for 5 over. It should say right on the ticket that you were actually going 82 in a 70 and the judge will know this. The cop was nice to write it for 5 over to reduce your fine and license penalty. Crying and saying it was only 5 over does not help.

Anyway, just show up to court, dress nice, be polite, say you are sorry and your cruise control was on higher than you expected and you are going to get it checked. You have a good chance of getting out of it just by showing up and being nice since it is only 12 over.

Find out if the ticket gets reported, or if that level is just a fine. If it's just a fine, pay it and move on. If your insurance company will get a report of it, then definitely contest the ticket, as it will end up costing you much more.

If i had absolutely nothing else to do, i'd go to court . . . .

. . . . i got my first ticke in 12 years last Fall . . . 10.5 miles over the the speed limit by a radar cop . . . cost me less than $100 (in Cali) and 1 point . . . . 1 point does not affect my insurance . . . as long as i do not get another (within 3 years), it resets to 'zero points' . . . and IF i somehow get another, there's always 'traffic school'.

my insurance is through the company I work for. therefore it wont matter at all because i do not see the bill. I am trying to plan for the day when I do not work for this company and have to get my own insurance though.

so you all suggest finding out if it gets reported...

the lady at the court (when I called her) said that usually it doesn't show up, unless they run a search. like if I start new insurance..

I am not bitching about it. I know for a fact I was going 79 though. I don't ever go over 10 over. I drive pretty much all day for my job so I know the limits of speeding. obviously not that well though.

again. no points are attached to the ticket and the fine is $95

Well I dont know how that goes but if you have a ticket it means you need to go to the court even though no points are taken. If I got a ticket here in Indiana and didnt show they would hold me in contempt. License would get suspended and a warrent would be out for my arrest. Now wouldnt that make thing even worse for you if your courts is the same over a lousy 5mph speeding ticket? I can promise you with 99% certinty you will get supervision and it thrown out if you show but if you are a no show you couldbe up the creek with out a paddle. take the day or half the day off, give the judge the pouty dog eyes, tell him how sorry you are and it si your first ticket and walk away with a slap.
Lot of people tell you to fight it or pay. Well paying may be more then what you would miss if you just took the day off from work. Fighting it means you will be set up with yet another court date to sow up and pled your case before a jury causing you to miss more work. Not showing up may cause you to loose your license and a warrent for your arrest. Or just show up like I mentioned and have it thrown out and walk away smiling (as long as you keep clean and no more tickets within the time frame he gives you).
I know what I am talking about btw. when I was a teen I showed up infront of the jusge plenty times and everytime it was thown out and got court supervision. Once the date passed I was wreckless again and speeding. Hell I have even passed cops up on the freeway twice doing over 100 MPH and they didnt even give me a ticket. Soits just how you talk to the judge or cop at the time.

The judge will know that you were going 12 over.
I just found that out the other day - the reason a judge said to me "must have been a road reduction, huh?" from a ticket I got many many years ago... it was written for 9 over, instead of 12 or 13. Fewer points, lower fine.

I am not required to go to court.

She did mention a third option which is to write a letter to the magistrate and speak like I would if I was at the court.

Also, so the best POA at the court is to admit guilt huh?

Just pay it. That cop was awesome for only giving you a ticket for 5 over. It will cost you very little to pay it, and you won't get any points on your license.

man, I once got pulled over doing 88 in a 65 mph zone, and got off with a warning, b/c I insisted to the officer that I was crusing at 75 max. He was p.o.'ed, but let me off with a warning b/c he didn't want to ruin my 'spotless' driving record.

Yeah, you may have plenty of experience with speeding and going to court. But you are a major DUMBASS to still be speeding after so many speeding violations.
