Spam domain names

I'm looking at doing another start-up company, and the website with the name I want is already taken by a spammer with nothing but advertisements. I emailed the person that owns it and he said the site name is not for sale, so I did a little research on him and he is llisted as a reference for one of those stupid get rich through google ads websites.

Are there any options other than finding a different name? If I own a trademark on the name can I do anything about it?

Yeah but nissan.com is a legitimate business (despite how FAIL the website is). Having a bunch of shitty ads is not.

Here is the site, there are a few other TM's on the name, but none are in the same industry as me and I believe 2 are abandoned.

Well actually, his site is a legitimate profit making venture that existed before yours. If he went out and took the domain after you had already gained some sort of recognition, then you'd have some options.

I'm working on a different name and there's a couple of different ways of naming it (drive-smart.com, I already emailed the owner). He claims there's no price on it, but I replied telling him money isn't too much of an issue as long as he's not ridiculous about it.

I'd prefer if the government just stepped in and seized the domain names and gave them to their right owners (large corporations with copyrighted names and brands.) The need for money to change hands in a free market is what slows the whole process down and leaves so many spam domains operating today.

If I was Nissan Computers, I'd take a few million and get a new domain name. I don't see the big deal. With Nissan Autos being a big brand, his website of nissan.com probably confuses his customers anyway.
